Bailey & Wyant, PLLC congratulates Member Jordan K. Herrick on being one of two individuals in West Virginia named by  
Super Lawyers Magazine as a Rising Star in Personal Injury Defense.  This is the fifth year in a row he has been selected.

Jordan is a native of New Martinsville, WV and graduate of West Virginia University School of Law.  Since 2017 he has been Vice Chairperson of the Insurance Law Committee for the Defense Trial Counsel of West Virginia. He resides in Charleston and is an active member in Charleston's East End Community.

Bailey & Wyant, PLLC's, David L. Wyant obtains Summary Judgment

 
 
Bailey & Wyant, PLLC's,Managing Member, David L. Wyant along with Member Diane Senakievich obtained a Summary Judgment in Circuit Court of Brooke County on a whistle blower claim. 
 
The claim was brought on by three school bus drivers.  The West Virginia Supreme Court of Appeals affirmed this Summary Judgment Order.    
 
David obtained his undergraduate degree from Miami University of Ohio, and J.D. from Indiana University College of Law.  He is a Past-President of the West Virginia Defense Trial Counsel, a member of Defense Research Institute, and recognized as one of the Best Lawyers in America 2020.

Diane is a native of Wheeling, WV.  She obtained her undergraduate degree from Ohio University and her J.D from Ohio Northern University.  Diane is also a member of the Defense Trial Counsel of West Virginia an recognized as a Best Lawyer in America 2020.

Bailey & Wyant, PLLC's, Managing Member, Charles R. Bailey, is completing his term as Committee Chair for the Defense Trial Counsel of West Virginia's Board of Governors.  He has been invited and encouraged to remain Executive Editor for the WVDTC's Publishment, "The Defender."   
 
Charles joined the WVDTC in 1983 and has been highly regarded and praised by Executive Director, Peggy Schultz, as "a wonderful contributor and supporter of the Defense Trial Counsel of West Virginia."
 
The WVDTC is designed to bring together attorneys who defend individuals and corporations in civil litigation for the purpose of elevating the standards of West Virginia trial practice; supporting and advocating for the improvement of the adversary system of jurisprudence; and increasing the quality of services rendered by the legal profession to the citizens of West Virginia.  
 
 
Bailey & Wyant, PLLC, favorable result in wrongful death case.
 

 
 
Bailey & Wyant, PLLC's Of Counsel, Abbie C. Dunn and Managing Member, Charles R. Bailey received a favorable result in a wrongful death case stemming from a tractor trailer accident in WV on behalf of an out-of-state manufacturer/shipper of a product.
 
The case was brought in Federal Court by the self-proclaimed experts in wrongful death trucking cases out of Toledo.  They received a motion to dismiss based on a number of grounds (Jurisdiction; failure to state a claim and federal preemption) pending.
 
The Plaintiff's counsel indicated to voluntarily dismiss the case with prejudice against the client so as not to have respond to the Motion to Dismiss or serve answers to the discovery.
