It's Official! You Can Start Filing for
Retroactive Alternative Fuel Tax Credits
As of February 14, 2020, alternative fuelers can officially start filing for your retroactive alternative fuel tax credits on propane motor fuel for 2018 and 2019.

As a reminder, in order to start claiming the Alternative Fuel Tax Credit, an individual or entity must be registered as an alternative fueler. Claimants can register using IRS Form 637, Application for Registration (For Certain Excise Tax Activities). 

The credits were reinstated retroactively for 2018 and 2019 under the Taxpayer Certainty and Disaster Tax Relief Act of 2019 and signed into law in December 2019 by President Trump. 

The IRS is providing a 180-day period for companies to claim retroactive tax credits, beginning Feb. 14 and ending August 11, 2020. Retroactive claims received after August 11, 2020, will not be processed by the IRS.

Each claimant must claim all 2018 - 2019 alternative fuel incentives for which the claimant is eligible on a single Form 8849 along with Schedule 3 (Form 8849) , which was recently updated on Irs.gov .

Reminder. You must claim credits using the Gas Gallon Equivalent (GGE). 1 gallon of gasoline = 1.353 gallons of propane.

Page 3 of Schedule 3 (Form 8849) gives an example of a claim for LPG.
IRS example claim. 10,000 gallons of LPG ÷ 1.353 = 7,391 GGE x $0.50 = $3,695.50 claim amount.

TPGA Technical & Standards (T & S) Committee
to Review New LP Gas Safety Rules
The Texas Propane Gas Association (TPGA) Technical & Standards (T & S) Committee will meet next week outside of Austin to discuss the recent adoption of the new  LP Gas Safety Rules  by the Railroad Commission of Texas.

The committee, made of members like yourself, will review flagged rules and outcomes from members' comments and discuss the next steps.

In addition to our T & S committee, the association also has technical experts that serve nationally on the national NFPA 54 and NFPA 58 committees. Their involvement in the national committees provides a voice for the propane industry as the National Fire Protection Association crafts standards and regulations for our industry. It helps keep the association informed of what's coming down the pike.

As a reminder, effective September 1, 2020, Texas will go by and enforce the 2018 NFPA 54 and 2017 NFPA 58's.
