Trends in Damage Awards by K-12 Schools and Universities

We have been talking about Risk Management Committees recently on our Online Forum and in our Chair Chat this past week. One of our members, Travis Warren, who is Board Chair of Proctor Academy in New Hampshire, shared a report from United Educators on the trend of high damage awards in K-12 schools and universities.

Below are two excerpts from that report. Note that the report indicates that private or independent schools don't have the same reporting requirements as public institutions so their unreported claims are not part of the data presented in this report. Even without some of the independent school data, these trends are very concerning.
The number of settlements and awards well as the size of those awards have increased significantly over the past 6 years with a sharp increase in 2021. Sexual misconduct cases still tops the list for the highest number of awards or settlements over $1 million. It will serve boards well to understand the greatest liability risks facing schools by reading this report.
