MIOSHA Withdraws Permanent COVID-19 Workplace Safety RulesGovernor Gretchen Whitmer and Republican legislative leaders announced a deal that will stop any further action on the permanent COVID-19 Workplace Safety Rules that the Michigan Occupational Safety and Health Administration (MIOSHA) has been working to promulgate. Today, MMA’s Dave Worthams received official notice as chair of the MIOSHA permanent rule workgroup that MIOSHA withdrew the permanent rule and canceled the previously scheduled public hearing. This is a significant win for manufacturers. MMA has battled fiercely to prevent the imposition of uncompetitive regulations that are overly burdensome, inconsistent with federal guidelines and contradictory to science. While this announcement is a clear victory for manufacturers, employers should note that MIOSHA Emergency Rules continue to be in place, as does the 5/15/21 Michigan Department of Health and Human Services (MDHHS) Gatherings and Face Mask Order. However, we expect MIOSHA to issue revisions soon that will remove the mandate that employers prohibit in-person work to the extent that work activities can feasibly be completed remotely and to make changes aligned with new CDC and MDHHS face mask guidelines for fully vaccinated individuals. Additionally, a revised Gatherings and Face Mask Order is expected to be issued Monday that will further relax restrictions related to the pandemic. MMA will provide a written review of the updated orders shortly after they are released.
