It has been another busy month for the Association with our advocacy efforts really ramping up pressure on Government in the lead up to the Federal Budget on 11 May 2021 in Canberra.

Following a meeting with the Treasurer this week, we know the focus will be on skills as the Government has set an ambitious agenda to drive unemployment lower than 5%. What is impressive about this target is that it has only occurred twice in the nation’s history and does indicate that support for industries that have major vacancies will be in the budget. Our industry will have an important role to play and a new approach by Government and the Job Active Providers to fill our many and growing vacancies.

We also made a detailed submission to the Victorian Inquiry into the impact of the COVID-19 pandemic on the tourism and events sectors. The impact of COVID-19 on the Victorian Tourism Accommodation Sector saw losses in room revenue alone top $1.7 billion as of year ending February 2021, according to modelling conducted by AHS Advisory. COVID-19 is now the single largest peacetime economic contraction for our Sector.

While many other sectors have rebounded quickly, the modelling undertaken by AHS Advisory demonstrates that the path to recovery for the tourism accommodation sector will take at least four years.

New Casual Conversion Laws

Before the amendments took effect on 27 March 2021, the Hospitality Industry (General) Award (HIGA) was one of the few awards to provide casual conversion entitlements.

This entitlement continues for existing and future casual employment, with some modifications.

Can I use a business name that is similar to someone else's?
 
Maybe, but there is a big BUT.
 
If you use someone else's business name, and that name has been trade marked (or sometimes even if it hasn’t), it could lead to claims of a trade mark infringement, 'passing off' or an offence under the Competition and Consumer Act.
 
Regardless of whether the name was adopted intentionally or innocently, this can lead to financial penalties/damages and injunctions, which may mean you have to stop using the name and completely rebrand.
 
As with most legal issues, it is best to get advice upfront, before starting to use a name and even before registering a name with ASIC.
