Construction Contracts Event


Huge changes in the law require form contracts to be updated and creates a dilemma regarding whether to use an in-house form or an industry form. To date, as best we know, the AGC-MN form contracts are the only contracts updated for the new laws. 


AGC members as well as non-members who have purchased the 2023 AGC contracts are invited to join us on September 15 for a discussion. This event will be in-person, potentially with a remote option.


Tentative Agenda:

  • Two construction law firm attorneys who serve on AGC-MN’s contracts committee will present and answer questions (Kyle Willems from Bassford Remele and Jevon Bindman from Maslon LLP).
  • Explain how AGC-MN contracts work in general and compare with other industry forms (ConsensusDocs and AIA particularly)
  • Emphasis on the big three contracts (owner, subcontractor, and material purchase)
  • Explanation of other contracts
  • Use of drop downs instead of numerous versions
  • How AGC-MN contracts addressed the new laws (particularly duty to defend, wage theft, IRA, Buy America, Davis-Bacon).
  • Understand the theories, strengths and weaknesses of these new terms
  • Understand how new laws can impact practices, may create new costs and landmines to avoid
  • Tips on how to negotiate contracts with owners, generals and subcontractors, particularly to address the new laws to avoid landmines
  • Q&A time

Working with the New Ban on Non-Competes


Participants at this week’s AGC HR Forum asked for insights into Minnesota’s ban on non-compete agreements and language to bolster trade secret and protections of proprietary information. In response, member law firm Littler provided an article addressing these questions, available here.

Mark Phillips dies at 73


AGC is deeply saddened to learn of the death this Wednesday of former Iron Range Resources and Rehabilitation (IRRR) Commissioner Mark Phillips.


During his career, Mark was employed by AGC member Kraus-Anderson Construction, where he was a passionate and engaged advocate for the Minnesota construction industry. He was a leader of the Building Jobs Coalition and the AGC Legislative Committee. His insight and knowledge of the political process and construction markets helped bring advocates and policymakers together to leverage investments in construction. 


The AGC family extends our condolences to the Phillips family and to all those who knew Mark and called him friend. His legacy of public service and industry advocacy is celebrated and has left an enduring impact on Minnesota.

Marvin T. Fabyanske (1945 - 2023)

Marvin T. Fabyanske, a giant in construction law, passed away peacefully surrounded by family on August 15, 2023. Marv was born on January 22, 1945. He studied engineering in college, graduated law school in 1972, and quickly made a name for himself as one of the finest construction lawyers in the Midwest. In 1981, he founded Fabyanske, Westra, Hart & Thomson, growing the firm from two attorneys to now forty lawyers and a national reputation for excellence in construction law.  


Marv served as a mentor to many other construction lawyers. He was known for his superlative advocacy and wise counseling for his construction contractor clients, many of whom are AGC of Minnesota members. He spoke with extraordinary clarity and had the respect of all. He will be missed. Funeral services will be held Friday, September 8, 2023 (1:30 - 4:00 pm), at Falcon Heights United Church of Christ, 1795 Holton Street in St. Paul.

AGC 2023 DEI Awards


Applications for the second annual AGC DEI Awards are now open! These awards recognize member businesses for their initiatives in the diversity, equity, and inclusion space, and are presented in four categories:



All applicants must be members in good standing with AGC of Minnesota for at least one year, and must sign the Culture of CARE Pledge. Submissions must relate to activities or initiatives conducted in the past 12 months.


Entries are judged by the AGC of Minnesota Diversity & Inclusion Judging Committee, based on the information provided in the application. Judges are non-members who are business owners, or work in educational institutions, government entities, and community-based organizations that work in tandem with the construction industry.


The 2023 Awards will be presented at the AGC Honors event on January 16, 2024 | St. Paul Event Center

Want to improve job site safety and improve underground utility locating?

 

Join the AGC Worker Safety and Damage Prevention Subcommittee and attend the next meeting online this Thursday, August 31. This Subcommittee complements the broader AGC Safety Committee and AGC Utility Infrastructure Division.


AGC contractor members may attend. The primary goals of the meeting are to update AGC contractors on key legislation, current MNOPS activities, and more.

How to Beat the Heat: What Contractors Need to Know About OSHA’s Recent Heat Hazard Alert


Due to excessive heat across the country, OSHA recently issued a hazard alert to notify employers of their obligation to protect workers against heat and announced it will be increasing enforcement efforts in high-risk industries such as construction. Constructability Review:

SP 7212-21 (TH 93) – Flood Mitigation Project


MnDOT is asking potential contractors to assist with evaluating construction staging/scheduling and risks to delivering this project. MnDOT requests on-on-one meetings with potential construction contractors to review the draft plans and draft CPM schedule and provide feedback.


The meetings are expected to last approximately 90 minutes. September 18-22, 2023 has been selected as the Department’s desired time period for constructability reviews. We are planning to have electronic meetings/teleconferencing using ‘Microsoft TEAMS’ software. 20-Year CHASE Recognition Event


The Construction Health and Safety Excellence (CHASE) program is celebrating its 20th year with a special event to honor the participating contractors whose stellar safety records continue to lead the Minnesota construction industry!

The CHASE program began in 2003 as a partnership between Minnesota OSHA and AGC of Minnesota. Twenty years later, it is still the longest-running partnership with MNOSHA. The program is designed to recognize AGC member contractors for their safety programs and performance, while providing incentives for partnership.
