The mission of the Employment Law Council is to effectively represent Illinois employers on employment law issues such as workers compensation, unemployment insurance, employment discrimination, workplace mandates and other management/employee issues. We advocate public policy actions that advance the interests and viewpoints of employers, and to assist in creating a political climate conducive to improving Illinois' ability to create and retain jobs.

The Council accomplishes its mission with the involvement of hundreds of employers who participate in our three committees: Workers' Compensation; Employment Law & Litigation; and Unemployment Insurance. Through the efforts of these committees we develop policies and strategies that are implemented by the Council and Illinois Chamber staff.


Bills Signed & Dozens Heading to Governor for Signature

Prevailing Wage Civil Liability Expansion: PA 103-48/HB 3491 (Hanson/Preston) - amends the Prevailing Wage Act. Any laborer, worker, or mechanic who is employed by the contractor or by any lower tier sub-contractor and is paid for services in a sum less than the prevailing wage rates for work performed on a project shall have a right of action for whatever difference there may be between the amount so paid and the prevailing rates required to be paid for work performed on the project. Effective January 1, 2024. The Chamber was neutral.
 
Workers’ Compensation License Revocation for Failure to be Properly Insured: PA 103-26/HB 2145 (Evans/N. Harris). Amends the Department of Professional Regulation Law, the Asbestos Abatement Act, the Lead Poisoning Prevention Act, and the Illinois Plumbing License Law requiring the Department of Financial and Professional Regulation (DFPR) to refuse the issuance or renewal of a license to, or suspend or revoke the license of, any individual, corporation, partnership, or other business entity that has been found by the Workers' Compensation Commission or the Department of Insurance to have failed to secure workers' compensation obligations in the manner required by the Workers' Compensation Act, to pay in full a fine or penalty imposed due to a failure to secure workers' compensation obligations in the manner required by the Workers' Compensation Act, or to fulfill all obligations assumed pursuant to a settlement reached with the Workers' Compensation Commission or the Department of Insurance relating to a failure to secure workers' compensation obligations in the manner required by the Workers' Compensation Act. In various provisions concerning licensing, provides that no license shall be suspended or revoked until after the licensee is afforded any due process protection guaranteed by statute or rule adopted by the Workers' Compensation Commission or the Department of Insurance. Effective January 1, 2024. The chamber was neutral.
 
Reduction of Monetary Damages under Labor Dispute Act: PA 103-40/HB 2907 (Yednock/Villivalam) – Provides that no award of monetary damages, except for damage done to an employer's property as a result of conduct prohibited by law, shall be granted by any court of this State in any case involving a labor dispute. Effective January 1, 2024. The Chamber was opposed.
 
Increase in Penalties for Interfering in a Labor Dispute: PA 103-45/HB 3396 (Yednock/Villivalam) - Provides that a person who, with the intent of interfering with, obstructing, or impeding a picket or other demonstration or protest, places any object in the public way commits a Class A misdemeanor with a minimum fine of $500. Effective January 1, 2024. The Chamber was opposed.

Illinois Chamber & Illinois Self Insurers Association Co-Host Workers’ Compensation Conference
 
For many years both the Illinois Chamber and the Illinois Self Insurers Association have separately provided an annual workers’ compensation conference. Beginning on October 17, 2023, both organizations will jointly hosting an annual one-day conference at the Hilton Double Tree in Lisle Illinois.

On behalf of the 13,000 members of the Illinois National Guard, you are cordially invited to celebrate the establishment of Camp Lincoln with us as well as attend a presentation on how local businesses can compete for millions of federal dollars in supplies and services purchased in Illinois by the Illinois National Guard each year. 

The presentation will be led by the United States Property and Fiscal Office for Illinois' Supervisory Contract Specialist Lt. Col. Mark Williams and will be held on July 6 at 10 a.m. in the Illinois Military Academy auditorium on Camp Lincoln, 1301 North MacArthur Boulevard, Springfield, IL 62702. 

On July 6, 1886, by order of Governor Richard J. Oglesby, Adjutant General Joseph W. Vance issued General Order 14. It read, “The permanent camp and rifle range established for the Illinois National Guard, near Springfield, is hereby designated and will be known as Camp Lincoln.” The camp consisted of 160 acres, is a mile long and a quarter mile wide and is just a half mile from President Abraham Lincoln’s tomb. The land originally cost $18,100. 

Throughout 2023 the Illinois National Guard is celebrating its 300th Birthday by marking significant dates in the history it shares with communities across Illinois. Among those communities are Greater Springfield business leaders. Camp Lincoln is the headquarters of the Illinois National Guard and one of its key training and maintenance facilities. Camp Lincoln and the 183rd Wing bring in millions of federal dollars to Springfield each year and the Illinois National Guard is among the city’s largest employers.
