OSHA Releases Proposed Heat Injury and Illness Prevention Rule - On July 2, the U.S. Department of Labor released a proposed rule Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings Rulemaking which includes an unofficial version of the proposed rule available for viewing. An official version will soon be published in the Federal Register at which time there will be 120 days to submit comments.

 

Heat is the leading weather-related killer and is becoming more dangerous with record breaking hazardous temperatures. The proposed rule will help protect approximately 36 million workers, and substantially reduce heat injuries, illnesses and deaths in the workplace by implementing regulations and practices that include:

 

  • Requirements for identifying heat hazards; initial trigger with heat index of 80F and high heat trigger of 90F,
  • Written heat injury and illness prevention program and response plan,
  • Implementing work practice standards for rest breaks and drinking water,
  • Require a plan to protect new or returning workers that are unaccustomed to working in high heat,
  • Required training for supervisors and employees,
  • Additional recordkeeping requirements.


The recent overturning of the Chevron Doctrine and this fall’s Presidential election may call into question whether the proposed standard is adopted. Experts think there are many good reasons that this will never take effect, but their perspective is that it has very useful information and can bolster safety practices for contractors. CONSTRUCTION DATA

Construction Starts - Fall 19% in June to a seasonally adjusted annual rate of $1.0 trillion. On a year-to-date basis through June 2024, total construction starts were up 7% from the first six months of 2023. Over 12 months starting June 2023, construction starts were up 1%, while nonresidential building starts were down 7%, and residential starts were up 7%.


Dodge Momentum Index - Expands Another 8% in July increasing to 216.3 and 17% higher than July 2023. “While data centers have had an outsized influence on nonresidential planning activity in recent months, more momentum is building across many other major sectors and diversifying the story behind July’s growth,” said Sarah Martin, Associate Director of Forecasting at Dodge Construction Network.


Architectural Billings Index - Business conditions remained soft at architecture firms in June with an ABI Billings score of 46.4, which is up from the May score of 42.4, yet both are still below 50 meaning that billings have declined. The Northeast is the only region, for the first time since January 2023, reporting a slight increase in billings. Design Contracts remained at 45.6 in June and May, although down from 49.2 in April. 


New Jersey's Unemployment Rate Remains Stable – The unemployment rate remained at 4.6% in June with total nonfarm employment slightly decreasing by 1,200 jobs from May to June without change to the construction sector. Of the 58,300 added nonfarm jobs between June 2023 to June 2024, 3,100 were in construction.
