In this edition of the Monday Morning Messenger, TPGA highlights how propane was highlighted during the world-renowned Climate Week during this electrify everything time.


In case you missed the deadline last week, TPGA was able to get the hotel reservation deadline extended until the end of today. We hope you will join us for the last board & committee meetings of the year, where we will discuss more rules the RRC is considering filing and legislative session updates.


In our third story of the morning, the association provides an update from the last session on proposed new rules that mandate backup generation and give additional allowances for propane and natural gas.


The time has come; later this week, you can finally start applying for first through third-quarter alternative fuel tax credits. Check out our last story of the morning with a reminder on how to claim these retroactive credits.

During Climate Week

Late last month, Propane Education & Research Council (PERC) CEO Tucker Perkins sat down with several representatives from the media during Climate Week in NYC to talk about clean energy in his Path to Zero Podcast.


Climate Week is a summit that takes place in conjunction with the United Nations (UN) General Assembly and the City of New York, bringing together international leaders from business, government, and civil society to highlight global climate action. 


During Climate Week, Tucker was able to host notable media figures from Vox, HuffPost, Good Morning America's chief meteorologist Ginger Zee, and others.


The podcast talks about multiple energy sources but also gives Perkins a chance to speak with leading climate representatives about propane in an electrifying everything world.

Long-Anticipated Rules

Mandating Generators at Renal Facilities Proposed

You might see an uptick of requests for emergency backup generation from end-stage renal disease (ESRD) facilities from across the state soon.


The increased demand will be due to a new state mandate that could take effect as early as next month. The Texas Health and Human Services Commission (HHSC) is finally proposing their long-awaited to implement Texas Senate Bill (SB)1876, 87th Legislature, Regular Session, 2021. SB 1876 was adopted after the grid failure impacted by Winter Storm Uri and requires an end-stage renal disease facility (ESRD) to adopt a written emergency preparedness, and contingency operations plan to address the provision of care during an emergency and an emergency contingency plan for the continuity of essential building systems during an emergency.


As part of that legislation and rulemaking, the facility will be required to have an onsite permanent emergency generator with a Type 2 essential electrical distribution system in accordance with National Fire Protection Association (NFPA).


The emergency generator shall require an onsite fuel source and enough fuel capacity in the tank for a period of 24 hours or more unless propane or natural gas is used; then, a 24-hour fuel supply is not required.


Instead of a backup generator, an end-stage renal disease facility does have the option to execute a contract with another licensed ESRD facility within a 100-mile radius of the facility, stipulating that the other ESRD facility will provide emergency contingency care to the facility’s patients. The other ESRD facility with which the facility contracts must have an alternate power source.


Earliest possible date of adoption: is November 13, 2022.

RULE PROPOSAL

Alternative Fuel Tax Credit

Claim Period Opening This Week

Just a reminder Inflation Reduction Act (IRA) renewed the 37 cents per gallon alternative fuel tax credit for propane motor fuel sold retroactively for 2022 and prospectively through 2024.

 

Alternative Fuel tax credit claimants must follow specific instructions in Notice 2022-39, summarized below, to make a one-time claim for the alternative fuel credit.

 

The one-time claim is for alternative fuels sold or used during the first, second, and third calendar quarters of 2022 (January 1, 2022 - September 30, 2022).


The 180-day claim period for making a 2022 one-time alternative fuel claim begins on this week on Thursday, October 13, 2022, and ends on April 11, 2023. You can only claim these retroactive credits during this time.

 

How To Make a 2022 One-Time Alternative Fuel Claim

• Claimants must submit claims on Form 8849, Claim for Refund of Excise Taxes.

• Claimants must include Schedule 3 (Form 8849), Certain Fuel Mixtures, and the Alternative Fuel Credit with their submission and enter any amounts on Line 3 of Schedule 3 (Form 8849), as appropriate.

• Each claimant must claim the alternative fuel credits and payments for which the claimant is eligible for the first, second, and third calendar quarters of 2022 on a single Form 8849 and Schedule 3 (Form 8849).

• Claimants must follow the instructions to Form 8849 and Schedule 3 (Form 8849) when preparing their submission to the extent that those instructions do not conflict with this Notice 2022-39.

• Claims may be submitted electronically or by mail. Electronic submission is strongly encouraged and will result in faster claim processing and payment. Claims may be submitted electronically through any electronic return originator, transmitter, or intermediate service provider participating in the IRS e-file program for excise taxes. Any claimant that prefers to submit a paper claim may mail their claim to the address listed for Schedule 3 (Form 8849) in the instructions to Form 8849 under Where to File.

• Claimants must be registered by the IRS to make a 2022 one-time alternative fuel claim. Claimants not already registered by the IRS may apply to the IRS for registration by filing Form 637, Application for Registration (For Certain Excise Tax Activities), and following the instructions to Form 637.

• Claimants must have and maintain adequate records to substantiate eligibility for the 2022 one-time alternative fuel claim.
