PARTNER'S PERSPECTIVE

Austin T. Hamilton - The Power of Positivity: Boosting Well-being Through Celebrating Small Wins and Big Wins Alike

In our fast-paced world, filled with ambitious goals and grand aspirations, it is easy to overlook the significance of small victories. However, there is a profound impact that celebrating small wins can have on our overall sense of positivity and well-being.

Small wins may seem insignificant in the grand scheme of things, but they play a crucial role in our journey towards achieving larger goals. Whether completing a task ahead of schedule, receiving positive feedback on a project, or making progress toward a personal goal, these small victories provide a sense of accomplishment and validation. Small wins also reinforce the behavior that led to the win and motivate us to continue moving forward.

Celebrating small wins fosters a sense of positivity that permeates every aspect of our lives. When we take the time to acknowledge our achievements, no matter how small, we shift our focus from what is lacking to what has been accomplished. This positive mindset may not only enhance our mood but may also improve resilience in the face of challenges. Instead of dwelling on setbacks, we are able to maintain a sense of optimism and perspective, knowing that we have overcome obstacles in the past and we can do so again in the future.

Additionally, celebrating small wins encourages us to cultivate gratitude for our progress and the resources that have supported us along the way. By pausing to reflect on our achievements, we develop a greater appreciation for the effort and dedication required to reach our goals. This sense of gratitude not only deepens our satisfaction with life, but also strengthens our relationships with others as we recognize the role they have played in our success.

At Jimerson Birr, we celebrate the small wins (and the big wins too), on a weekly basis known as our “Weekly Wins.” We encourage each of our employees to take a moment to highlight one win for the week. This may be a personal win, such as a success at home or by a family member. This may be a professional win, such as helping a client resolve a dispute or obtaining a good result for a client. The goal is to share the win, no matter how big or small.

This week my weekly win is not an individual achievement. Rather, it is an achievement by my favorite sports team, the Purdue Boilermakers. I not only want to share this win internally with the firm, but I also want to share it with all of my friends, our clients, and anyone who reads this newsletter.

Specifically, the Purdue Boilermakers made the Final Four in the 2024 March Madness Tournament. Purdue had never reached the Final Four in my lifetime and the last time the Boilermakers were in the Final Four, my parents were at Purdue. Although Purdue did not win the NCAA Tournament, I was blessed to watch the Championship game alongside my parents at their house. That is a huge win for me and my family and is something I choose to celebrate. Rather than focus on the disappointment of losing the Championship game, I choose to focus on the fact that the Boilermakers were in the Championship game, and they had a fantastic season.

In addition to Purdue making the Final Four (which I consider a “big win”), I have been trying to celebrate the small wins on a daily basis. I like to reflect on the day, and the small wins help me recognize those things I am grateful for and have helped me have a more positive outlook on life in general. For example, at home, when playing football in the yard with my sons, rather than focusing on the numerous passes they may drop, I focus on the one big catch each one makes. While fishing with my family, I focus not on the size of the fish or the number of fish we catch, but on the fact that we are fishing together. Focusing on the small wins has given me a better appreciation for the positive aspects of my life.

Over the next month, I encourage you to start recognizing and appreciating the small wins in your life. The small wins at work. The small wins at home. The small wins of your children or your spouse. Hopefully, by appreciating the small wins, you will experience a better sense of gratitude and overall well-being and positivity. I implore you to appreciate the small wins and big wins alike.

What is the small win you are celebrating this week? Reply to this email to share it! We'd love to hear from you.

Until next time, Boiler Up!

Acquiring a money judgment through the litigation process in the State of Florida can be tough, arduous, and expensive. When a court enters a civil money judgment, it creates a judgment debtor and a judgment creditor. If the judgment debtor fails or refuses to pay the amount of the judgment, the judgment creditor may elect to use statutory collection methods to partially or fully satisfy the judgment.

"Why does the HOA care what I do in my backyard?” is an all-too-common question posed by homeowners. Responsible for maintaining the community rules, facilities, and appearance, homeowners’ associations have an important role in upholding community standards. However, a common complaint amongst owners revolves around their homeowners’ association’s (“HOA”) authority to govern what happens in the back or side yard of a home out of sight of the rest of the HOA.

The closing checklist serves as a deal roadmap, ensuring that all critical steps are taken, and no detail is overlooked. A well-prepared closing checklist can significantly streamline the closing process, minimize risks, facilitate discussions, and get the parties working together to close the deal.

If you have been paying attention to the news lately, you have likely seen stories surrounding a major shakeup with real estate commissions stemming from a settlement in a prominent federal lawsuit. On March 15th, a settlement was agreed on between the National Association of Realtors (“NAR”) and the U.S. Department of Justice (“DOJ”) who alleged anticompetitive practices. The settlement addresses concerns that NAR’s rules limited competition and hindered innovation in the real estate market.

Florida’s real estate landscape is dynamic and, at times, complex. One tool that real estate attorneys are often asked about and property owners often consider is the Florida Land Trust, governed by the Florida Land Trust Act, Sec. 689.071, Florida Statutes. This blog serves as an introduction to what a land trust is, explores the nuances of the Florida Land Trust Act (the “Act”), highlights when forming a land trust in Florida can be advantageous, and crucially, identifies when it might not be the most suitable option.

It is not uncommon for residential tenants to find themselves at a disadvantage when entering a lease agreement and renting residential property from a landlord. Often, the tenant is not sophisticated in real estate law or the relevant laws of the jurisdiction governing landlords and tenants. Additionally, in the past, landlords were not prohibited from discriminating against certain minorities or protected classes of people when leasing their property, which compounded these problems.

Modern Florida businesses often collect significant amounts of personal information in the ordinary course of their business. This information is attractive to threat actors who regularly use confidential information to commit identity fraud and to sell such information to other nefarious persons or entities. Accordingly, motivated and sophisticated hacker collectives often target healthcare providers and Florida businesses trying to compromise this valuable, sensitive information.

Curiosities, Ruminations and Various Eccentricities of Firm Biz

In court, pants split wide,

Lawyer's dignity denied,

Legal briefs on show.

The haiku above is the winning submission for JB's National Haiku Day competition and is a testament to the creative spirit of our employees, unlocked by our various cultural events this month.

Have you ever arrived at work dressed almost identically to your favorite coworker? This month, we did it on purpose for our annual twin day competition. There were a lot of laughs, and potentially, some mistaken identities.

In the spirit of the season, our team had a lot of fun as we embarked on our annual Easter egg hunt. Friendly competition reigned as we searched high and low. It was a day brimming with camaraderie, laughter, and a scurry of pursuit. It's events like these that remind us to take a step back from the hustle and bustle to enjoy the company of one another.
