MACOMB COUNTY PROSECUTOR'S OFFICE EMAIL NEWSLETTER

December 2023

Dear Community Members,

In a year marked by challenges, the Macomb County Prosecutor's Office, has emerged triumphant in fulfilling its goals, thanks to the unwavering support of the Board of Commissioners who have made the safety of Macomb County residents a priority. Addressing issues ranging from school threats to domestic abuse, the office initiated comprehensive programs to tackle these pressing concerns.

Notable achievements of the Macomb County Prosecutor's Office this year include the exoneration of an innocent man through the Conviction Integrity Unit, record-breaking collections in back child support, and exceeding our expectations in securing over $2.5 million in grants. My office's commitment to justice for all is evident in launching innovative initiatives, such as the Warrant Appeals Unit and a first-of-its-kind program for felony non-support cases.

The Prosecutor's Office has received national recognition with seven National Association of Counties (NACo) Achievement awards in Criminal Justice and Public Safety. Significant milestones this year also include a groundbreaking gun policy, the first appeal filed by the Office to the U.S. Supreme Court, and the implementation of a cutting-edge, new electronic case management system.

Community engagement has been the foundation of our efforts, from the impactful 2nd Annual "Knocking Violence Out of My School" video competition for high school students to extensive outreach programs, including the "Stopping Crimes Against Macomb Seniors" SCAMS program.

As the year comes to a close, I would like to express pride in all of our accomplishments, and recognize the hard work of my dedicated staff in creating a safer Macomb County.

The spirit of the season resonates with wishes for a Merry Christmas and a Happy New Year, echoing the hope for continued progress and a brighter future for Macomb County.

Sincerely,

Stopping Violence in Schools: What Parents and Students Need to Know!

Macomb County Prosecutor Peter J. Lucido Prioritizes Child Support for Macomb County Children

Prosecutor Peter J. Lucido's proactive approach to addressing child support arrearages in Macomb County has proven to be a resounding success. Through the implementation of two pilot programs by the Cooperative Reimbursement Unit, he has not only emphasized the importance of parental financial responsibility but has also prioritized the well-being of Macomb County children.

The first program, which encouraged parents to establish payment plans, has yielded impressive results, with over $501,864.82 collected this year. This not only underscores the effectiveness of the initiative but also reflects a significant contribution toward the support and care of the children in Macomb County.

Prosecutor Lucido's commitment didn't end there. The introduction of a second program, the Child Support Collection program, demonstrated a holistic approach to addressing the issue. By raising awareness among both custodial and non-custodial parents, he has created a platform for them to proactively address their child support obligations. This outreach program took place in November where parents who owed back child support for Macomb County cases, could walk in the Macomb County Prosecutor’s Office at any time without an appointment to begin making payments to avoid potential prosecution. Bringing awareness also resulted in custodial parents reaching out to the Prosecutor’s Office to initiate a case for receiving their unpaid child support. The success of the four-day outreach program resulted in substantial collections for Macomb County children and highlighted the positive impact of this initiative.

As the Macomb County Prosecutor's Office plans to continue the Child Support Collection days this summer, it signals an ongoing commitment to ensuring the financial well-being of the county's children. Prosecutor Lucido's leadership in this regard exemplifies a dedication to justice, accountability, and the betterment of the community.

“We will continue these impactful programs as we pursue our dedicated mission to collect unpaid and past due child support. This is a high priority of my office and we will continue to fight for Macomb County children,” said Macomb County Prosecutor Peter J. Lucido.

If you owe back child support and would like to begin making payments to avoid potential prosecution, please contact the Macomb County Prosecutor’s Office Felony Non Support Unit at 586-493-4488 or email: pafamilysupport@macombgov.org to make payment plan arrangements.

Macomb County Prosecutor Files First Appeal to U.S. Supreme Court

On Thursday, October 26, 2023, the Prosecutor’s Office filed its first Writ of Certiorari to the U.S. Supreme Court Circuit Court, in the case of People of the State of Michigan v Anthony Joseph Veach.

Veach was convicted of seven counts of first degree criminal sexual conduct and two counts of second degree criminal sexual conduct for sexually assaulting his daughter, when she was 15 and 16 years old. The defendant was sentenced to 20-60 years in prison for each of the first degree convictions and 10 to 15 years in prison for each of the second degree convictions.

Veach challenged the guilty verdicts, arguing that the court improperly closed the courtroom during the child victim's testimony without articulating the reasons on the record. The Michigan Court of Appeals upheld the closure, citing valid reasons on record; however, the Michigan Supreme Court disagreed and stated that the trial court's failure to articulate the reasons for the closure violated the Sixth Amendment of the U.S. Constitution. As a result, the defendant's convictions for raping his daughter were vacated and a new trial was granted. Justice Brian Zahra of the Michigan Supreme Court issued a strong dissent and asserted that the record clearly indicated justification for closing the courtroom during the child victim's testimony.

In its appeal, the Prosecutor's Office states that the decision wrongfully reverses the convictions of an otherwise fundamentally fair trial.

Thank you to All the Assistant Prosecuting Attorneys and Staff who have Retired!

We wish you well!

Macomb County Assistant Prosecuting Attorney Beth Naftaly Kirshner will be retiring from the Macomb County Prosecutor’s Office in January after over 30 years of service. Beth has been an assistant prosecuting attorney since 1993 and has served in the various courts, the appellate division, and the Family Support Division during her tenure in the office.

Beth has overseen the Family Support Division for over 10 years. She also served on various Boards and Committees for the Office of Child Support advocating for prosecuting attorneys who help families by establishing paternity and initial child support orders.

“I am grateful that Prosecutor Lucido supported our division and our mission which helped to make us a leader in the State of Michigan,” said Assistant Prosecuting Attorney Beth Naftaly Kirshner. “With the support of Prosecutor Peter J. Lucido, we successfully increased grant funding for the Family Support Division to better serve Macomb County families by establishing more child support orders. Additionally, with the vision and leadership of Prosecutor Lucido, we have grown the Felony Non-Support Program to help recoup unpaid child support. The high morale of our unit and supportive office culture is gratifying, but the most important thing is we are providing even more help for Macomb County children.”

Macomb County Prosecutor Peter J. Lucido stated, “I wish Beth the best in her new endeavor. She has done a terrific job with the Family Support Division Unit and will be dearly missed."

Assistant Prosecuting Attorney Bill Cataldo, Crime Victim Rights Advocate Kay McGuire, and Chief Investigator Craig Keith also retired this year from the Macomb County Prosecutor's Office.
