Artificial Intelligence Workshop

The MBA was invited to an Artificial Intelligence (AI) workshop hosted by the State of Michigan Department of Technology, Management and Budget last week. Jeanne Richter, Chief Risk Officer at The State Bank attended with the MBA to provide community bank perspectives on AI development in our industry, state government, and insights on future interactions of the two. From Responsible AI to success in public-private partnerships to policy around the use of this technology, the industry was well represented!

State Legislative Calendar Expectations

After a very lengthy session day on Wednesday, moving a slew of top policy priorities of the Governor and majority party, the Michigan House is expected to go home early today for the week. Our current expectations are that both the House and Senate will adjourn sine die sometime late next week. This would leave only the possibility of a special session at the call of the Governor available should the legislature determine there is more work to be done before December 31, 2023.

U.S. Congress Scheduled through November & December

After votes to sit a new U.S. Speaker for nearly a month, the U.S. House has now refocused its attention on the regular business of running the country. Due to time lost in October, they have added 3 additional weeks of sessions in both November and December. They will be in session every week between now and the end of the year, with the exception of the weeks of Thanksgiving and Christmas.

Alternatives to Garnishment Bills in the Works

The MBA and other stakeholders will meet with the bill's sponsor of HB 4900-01 and SB 408-409 later this week. Your MBA Advocacy team has been working diligently behind the scenes with legislators to find an alternative solution to this package of bills dealing with garnishment and bankruptcy. Sponsors of the bills have heard the industries concerns and our coming to the table to discuss amenable compromise.

Texas Court Expands 1071 Injunction to Cover All Banks

A Texas court last week expanded a preliminary injunction on enforcement of the CFPB’s Section 1071 small business data collection rule to include all financial institutions covered by the rule. The U.S. District Court for the Southern District of Texas in July granted the injunction to ABA and Texas Bankers Association members in a lawsuit over the rule brought by the associations and the McAllen, Texas-based Rio Bank. ABA and TBA asked at the time for the injunction to apply to all FDIC-insured institutions, but the judge sided with a CPFB request to limit the order to association members. The MBA, ABA and 50 state trade associations signed on to a letter and sent it to support the inclusion of all covered banks in the Texas court injunction.
