WHAT'S NEW?    

New Updates in California

Minimum Wage was increased to $15.50 effective January 1. Please be aware that different rates can apply to small employers (less than 25 workers) and increased rates may apply in certain other industries or in particular cities with higher “living wage” laws. The minimum salary rates for an exempt salaried employee in California is now $64,480 per year.

New prevailing wage laws now:

  1. Covers the on hauling of gravel, rock, sand, fill and related materials used for paving.
  2. Expands the exemption time frame of use of volunteer workers from a 501(c)3 non profit
  3. Mandates the DIR expand the eDocuments data base for access for Trust Funds and Labor/Management committees to obtain information protected by Labor Code Section 1776.

QUESTION: Why are things like temporary trailers and fencing covered by prevailing wage when they are not permanently going to be part of the project?

ANSWER:  Both California, Federal Davis Bacon and many other states consider temporary fencing and jobsite trailer on a prevailing wage project as part of the essential items which create a safe working environment for the project and part and parcel of the overall operation of the project. As these items are necessary for the proper building of the projects, prevailing wages applies to the placing and removing of temporary fencing as well as the placement and all hookups to a jobsite trailer. 

Items which are not covered by prevailing wages are the placing and servicing of porta potties, the off haul of sorted recyclable materials and routine garbage removal.

Note: Specific off haul of dirt or spoils is frequently covered by California and some state prevailing wage requirements.
