NEW VERSION OF AM4EV ACT

SUBCOMMITTEE HEARING SCHEDULED FOR TODAY

Building on the momentum for AM radio legislation on Capitol Hill, Reps. Gus Bilirakis (FL-12) and Frank Pallone (NJ-6) have introduced an updated AM Radio for Every Vehicle Act bill that they plan to move through the House Energy and Commerce Committee. This bill is identical to the Senate legislation that has garnered widespread support. 


Both Bilirakis and Pallone were holdouts on the original AM Radio bill and declined to become co-sponsors.


Now, it appears that their handiwork and tweaks for the “AM Radio for Every Vehicle Act” make it a bill with a fast track to the White House for signage by President Biden.


The new effort starts at 10am this morning during a House Innovation, Data, and Commerce Subcommittee markup session. This Subcommittee’s Chairman? Look no further than Bilirakis.

CAN AN ADVERTISER OFFER TO PAY SALES TAX?

Recently we received a legal hotline question regarding a commercial where the advertiser offers to pay the sales tax during a special promotion. Is this promotion legal in Kentucky even though the advertiser is located in Illinois?


While the spot itself isn't necessarily a foul, the "offer" is against the law in Kentucky. KRS 139.200 states, "it is unlawful for any retailer to advertise or hold out or state to the public or to any customer, directly or indirectly, that the tax levied or required to be collected (under this statute) or any part thereof will be assumed or absorbed by the retailer". KBA's legal team recommend a clear and conspicuous disclosure in the advertising that the sales tax holiday offer is void in Kentucky. We also talked to a representative from State and Local Tax, and he stressed that the “Prohibited Advertising” statute “has teeth” and the department is known for pursuing violators. 

NEW OVERTIME RULES

HOW THESE RULES AFFECT BROADCASTERS

A couple of weeks ago the U.S. Department of Labor published final regulations under the Fair Labor Standards Act (“FLSA”) that ultimately raise the minimum salary necessary to be exempt from federal overtime rules by 65%. These changes affect all businesses subject to the FLSA, but broadcasters and other media employers may particularly feel the impact given that they rarely operate on a 9am-to-5pm schedule. The increase will occur in two steps, with the first going into effect on July 1, 2024, and the second occurring on January 1, 2025. While these increases are certain to be challenged in court, the outcome of any appeals is difficult to predict. Employers need to prepare now to minimize the impact of these changes on their operations. Click HERE to learn more.

WHEN SEARCHING FOR NEW BUSINESS, WHERE DO I START?


I receive a weekly newsletter from Alex Goldfayn, a sales trainer and business growth consultant. You can subscribe HERE.  


Recently, Alex talked about proactive communication being the key to predictable sales growth.  This means we must talk to more people and get more people in the pipeline if we want to predict future growth.


But.


Prospecting is hard.


In his newsletter, Alex suggests there are three types of customers we may be overlooking in our new business development efforts:


  1. Current customers who are also buying elsewhere but could easily buy those additional products and services from you. In fact, it would make their lives easier to buy more from you. So, offer to help them with those products and services, and they will thank you with their additional business. 
  2. Customers who used to buy from you, but no longer do. These folks took their business elsewhere, and probably didn't tell you when this happened. Nobody likes to have breakup calls. They are in your accounting system, and you are in theirs. Go to them and let them know you'd like to help them again.
  3. Customers you got close to doing business with, but it didn't work out. I call this group "past prospects." 


The magic to these three groups is that you already know them.  You already have a relationship, or at least your company did. These groups are people who already know you.  So, technically, it’s not a cold call.

Alex suggests that with these types of prospects, simply call them and tell them you were thinking about them and would like to help them more, or again, or for the first time.  Play on the familiarity and tie that to a strong V.B.R.; it seems like an excellent recipe for success.


Consider asking your sales manager for a list of past customers; maybe you can turn that ugly word – ATTRITION – into a gold mine of new prospects!
