The White House issued Executive Orders that new tariffs will be issued for goods entered for consumption on February 4th, 2025. Customs and Border Protection (CBP) has published Federal Register notices to implement the tariffs imposed on and China and Hong Kong by President Trump on Saturday, Feb. 1. Currently Mexico and Canada tariffs are on hold for 30 days.
The China/Hong Kong tariffs will be 10% and in addition to any existing tariffs.
Under an executive order issued by President Trump, effective Feb. 4 de minimis entry is no longer available for imports from China subject to the additional ten percent tariff imposed by that EO, which include virtually all products of China (including Hong Kong). This suspension will remain in effect as long as the tariff does.
Section 321 of the Tariff Act of 1930 allows for the informal entry of articles that have a retail value of $800 or less and are imported by one person in one day. These de minimis shipments are free of duty and taxes and are subject to expedited clearance processing.
On February 5 an Executive Order was issued re-instating the de minimis entry for shipments from China and Hong Kong until further notice.
The US Postal Service (USPS) restarted handling packages from China and Hong Kong yesterday after putting a stop on Wednesday on the processing of parcels from those origins.
Customs is working diligently to put the tariffs in place as quickly as possible. It is likely that any entries with an entry date of 2/4 and beyond will require payment of those additional duties.
President Trump reached an agreement with Mexican President Claudia Sheinbaum and Canadian President Trudeau to delay the imposition of the 25% tariff on imports from Mexico and Canada for at least a month, as negotiations continue between the two countries.
