cBHT: Is FDA’s other shoe about to drop?

If you compound hormones, you need to know this: We learned this week that FDA is moving forward, as previously announced, with proposed rule-making on “demonstrably difficult” issues for both 503A and 503B – and possibly with adding new substances as “demonstrably difficult to compound” under the new criteria.

A draft rule, we’re told, is headed to the Office of Management and Budget for its mandatory review, and so we should likely anticipate an announcement of a proposed rule soon.


Here's the thing: We don’t yet know what’s in the proposed rule. No one does outside FDA. All we have is this abstract, which is startling in what it may not explicitly say.


Could this be the agency’s long-anticipated move, based on the now-discredited 2020 NASEM report the agency commissioned, to restrict compounded hormone therapy? Or could this be something else? At the moment we are not yet sure, but rest assured, your APC public policy team will be reviewing it and will likely be discussing it with FDA – including raising the issue with FDA’s Gail Bormel in her appearance at CCH on September 19. 


In a 2021 survey, 77 percent of compounders said cBHT was one of their top lines of compounded products. The patient base we collectively serve with those therapies likely numbers in the millions. And they’re counting on us to represent them.


If you compound hormones, your reasons for attending CCH likely just grew exponentially. Raising this matter with your member of Congress is urgent and essential to our ability to influence what is or is not included in a final “demonstrably difficult to compound” rule – or even quash such a rule altogether.


I urge you to get registered while there’s still time for us to schedule your Hill appointments.

APC comments on 503B wholesaling guidance, drug shortages

Earlier this week, APC submitted comments to the FDA docket regarding the draft guidance for industry, "Prohibition on Wholesaling Under Section 503B of the Federal Food, Drug, and Cosmetic Act Guidance for Industry.” The comments are in support of the draft GFI but request several specific clarifications be included in a final GFI. 


Last Friday, APC submitted comments to the Energy & Commerce committee on drug shortages to encourage the inclusion of HR 167 in any legislation to address drug shortages that the committee may pursue.

It’s not personal, it’s business

Compounders on Capitol Hill 2023 is coming in hot, with less than three weeks to go. Thus far we’ve thrown plenty of good reasons at you for taking two days in September to fly to Washington DC and make a case for pharmacy compounding to your members of Congress.


But as our Board Chair’s column above makes clear, there’s one reason that trumps all the others: Advocating for your business on Capitol Hill is political insurance. 


It’s how you protect your investment in your pharmacy or facility. It’s how you protect the jobs of those who you employ. It’s how you protect your ability to earn a living.


We need you with us on September 19-20. And so does your pharmacy.

APC member elevates compounding’s profile. Ndidiamaka “Didi” Okpareke, founder of Olive Tree Compounding Pharmacy in Rio Rancho, NM, was recently interviewed in the Albuquerque Journal.


Free FDA webinar on outsourcing facilities. FDA is offering a FREE, self-guided online course to support outsourcing facilities and other stakeholders in their efforts to enhance the quality of compounded drugs. The course highlights important regulatory information about requirements specific to outsourcing facilities.


One-year stabilization period added to DSCSA deadline. DSCSA requirements are scheduled to change on November 27, and include requiring trading partners to provide, receive and maintain all documentation about products and ownership electronically only. Earlier this week, FDA announced two compliance policy guidances that establish a one-year stabilization period to allow trading partners to implement, troubleshoot and mature their electronic systems.  


Wegovy’s heart benefits may take a while … and cost a lot. The good news was that Wegovy has shown to reduce cardiovascular events up to 20 percent in at-risk patients. The downside is, it’s going to be expensive, according to a recent analysis.
