Village Attorney John Dellagloria Explains the Current Status of the Group Home Business License
April 5, 2023
Village of Palmetto Bay
On March 3rd, the Village sent Notice to the owners of the Group Home at 7201 SW 174th St., advising its Business License is being revoked and that the Group Home had to cease operating by April 3, 2023. In response, the legal representatives for the Group Home and the Village agreed to allow an independent Special Magistrate review and decide as to whether the Village acted properly in deeming events that occurred regarding two individuals “eloping” from the facility constituted a “public nuisance”. A hearing took place before the Special Magistrate on March 30th, at which time it was agreed that a “community meeting” should take place, and the Special Magistrate continued the hearing to April 6th. The community meeting was held on April 4th; the Village is expecting a list of action items from the Group Home to hopefully remedy the situation that was the cause of the Village’s action.

Today, April 5th, the Village was advised by the Special Magistrate that he needed to continue the hearing to April 25th. During this period, the Village will continue to work with the representatives of the Group Home and will pause the revocation of the Business License until the rescheduled hearing.
