What's Hot!:

Even the Chicago area is being updated about the CO2 pipeline project slated for our area including Adams, Hancock, Schuyler and Brown Counties. Several companies are seeking to develop carbon dioxide pipelines. A Chicago Sun-Times posted article featured a coalition working to stop the pipeline project. Its Editorial Board recently called on lawmakers to put safeguards in place for the technology. (Click Here for Editorial).  Schmiedeskamp partner Jeff Terry, who follows the projects and represents landowners in dealings with developers, acknowledges that there is opposition. “The Biden administration,” he points out, “supports the carbon dioxide removal industry and provided funding to accelerate its development.” (Click Here for Article) Like it or not, the pipeline probably is coming; landowners need to be prepared. Terry emphasizes that “landowners certainly should be appropriately compensated, but it’s more than just money and landowners also need to ensure that easements include protections for their land and improvements.” 

Business:

Lawmakers advance bill mandating expected pay scale and benefit disclosure. House Bill 3129 passed the legislature and now proceeds to the governor. The Bill requires employers, with 15 or more employees in this state, to include the pay scale and benefits for a position in any specific job posting. This would include items such as job board postings, newspaper ads and postings made by a third party on behalf of an employer. The Bill further requires an employer to make all opportunities for promotion known to current employees within 14 days after the employer makes an external job posting for a position. The Bill authorizes the Department of Labor to investigate violations of the law.

Trademarks and Tradenames:

What’s in a name? A lot. Special names and phrases may be protected but those rights may be limited or lost.  The turf war between Taco Bell and Taco John’s is an example. According to news reports, the phrase “Taco Tuesday” is on the battlefield. Taco John’s claims the phrase in most states and Taco Bell thinks it should no longer be protected. According to Schmiedeskamp partner, David Penn, “The best way to protect a name or phrase is to register it with the U.S. Patent and Trademark Office.” He points out that there are common law protections as well but remedies are more limited. Penn emphasizes that, “For many businesses the name really is everything and more businesses should consider trademark or tradename protection.”     

Firm News and Highlights:

Partner John R Longlett marked his 51st anniversary of practicing law on May 16, 2023. Longlett received his Bachelor's Degree in Agriculture from the University of Illinois and his juris doctorate from the University of Missouri School of Law. After passing the bar and CPA exam, Longlett started and spent a majority of his law career with Attorney George J. Lewis, and in later years with his eldest daughter, Amy C. Lannerd, until her appointment as Circuit Judge, and current assignment as Justice of the Fourth District Appellate Court. In May 2018, SRNM was privileged to have Longlett join the firm with his assistant Michelle Turpin. They both have been a wealth of knowledge to the firm, and their expertise in estate and business planning, real estate, agricultural law and banking have and continue to be a great asset to the firm. As Longlett continues his focus of "treating clients and others the way he and his family would want to be treated"; he continues to bring great professional knowledge to clients and mentorship to our up and coming lawyers.
