DeSantis Signs Septic Inspection Bill
On Thursday, May 12, Governor DeSantis signed SB 856 into law, codifying parameters for third-party providers to perform inspections of onsite sewage treatment and disposal systems. As previously reported, FHBA championed SB 856 during the 2022 regular session to alleviate the backlog of septic inspections in local jurisdictions around the state. This legislation, which passed unanimously in both the House and the Senate, provides qualifications for private providers to conduct septic tank inspections, similar to the statutes allowing third-party providers for building inspections.
FHBA applauds the work of bill sponsors Rep. Fetterhoff and Sen. Brodeur who recognized the need to reduce this unnecessary delay for issuance of certificate of occupancy for homes that ultimately increases the cost of the home. Representatives Mike Giallombardo, Blaise Ingoglia, and Ralph Massulo, along with Senator Debbie Mayfield, were also instrumental in the success of this bill. The law is now set to take effect July 1, 2022.
FHBA has spoken to DEP Leadership and has been assured that beginning July 1 all local Departments of Health may accept Private Provider inspections of septic tanks. Private providers should use the standard DOH forms.
FHBA’s advocacy team will continue to update you when priority legislation passed this year is acted upon by the Governor.

On May 24, Ft. Lauderdale Federal Court Judge Roy Altman entered a permanent injunction barring a long-time certifier of structural plywood from Brazil, PFS-Teco. This comes on the heels of a lawsuit aimed at stopping the importation and sale of substandard structural plywood from Brazil.
After review by FHBA General Counsel, FHBA wants our members to know the following takeaways from the injunction:
1. PFS-Teco must revoke all PS 1 certificate from Brazilian producers within 7 days of the order (5/31) and remove them from the PFS-Teco website.
2. PFS-Teco cannot issue a PS 1 certificate or grade stamp to any Brazilian plywood mill going forward.
3. The permanent injunction cannot be lifted until PFS-Teco does the necessary testing to prove that Brazilian wood is sturdy enough to produce plywood that qualifies for the PS 1 certification AND puts in place proper testing procedures to ensure compliance in the future.
4. PFS-Teco is to work with any plaintiffs in any litigation in which the adequacy of performance of certification procedures for PS 1 certified plywood.
5. PFS-Teco must “urge the PS 1 Standing committee” to create a standards committee that will govern structural lumber in the US.
It remains unclear as to what shall be done with existing inventory or already installed plywood.
FHBA’s team will continue to work with NAHB and the supply industry to get answers to questions that you may be asking. Questions such as how to identify current inventory and what it will mean for current jobs, what can be done with that inventory, what to communicate to your customers who may begin to ask about this plywood being used on their recent projects, and other certifications that you can search for that are not at risk, just to name a few.
