Hospital Discounted Care Newsletter

This newsletter provides information and updates on the implementation of House Bill (HB) 21-1198, Health Care Billing Requirements for Indigent Patients, otherwise known as Hospital Discounted Care. Low-income patients who aren't enrolled in Health First Colorado or Child Health Plan Plus (CHP+) will have the opportunity to apply for financial assistance or charity care programs at the health care facility where they receive care.

Hospital Discounted Care Updates

Clarification on Settings Subject to Hospital Discounted Care


We want to clarify and correct our response to a question raised at a recent Hospital Discounted Care office hours and a recent Colorado Indigent Care Program Advisory Council meeting:


Lower income patients may apply for financial assistance under Hospital Discounted Care when health care services are provided at a facility that is licensed as an acute care or critical access hospital or freestanding emergency department or are provided at hospital-related outpatient facilities. Specifically, the requirements of Hospital Discounted Care must be followed for care provided at these facilities:



  • a hospital that is licensed or established as a general acute or critical access hospital
  • a licensed freestanding emergency department
  • any outpatient health care facility that is licensed as an on-campus department or service of a hospital or that is listed as an off-campus location under a hospital's license except:
  • a Federally Qualified Health Center, or
  • a student-learning medical and dental clinic that is established for the purpose of student learning, offering discounted patient care as part of a program of student learning, and is physically situated within a health sciences school.


Hospital Discounted Care requirements do not apply for health care services provided at facilities that are not licensed as a general or acute care hospital or freestanding emergency department. Some examples are noted here:



  • Hospital Discounted Care does not apply to care provided in
  • Hospital-based nursing facilities that are licensed as nursing facilities and are not operating under the hospital's license  
  • Facilities licensed as an Ambulatory Surgery Centers located on a hospital's campus and are not operating under the hospital's license      
  • Hospital Discounted Care does apply to care provided in
  • A hospital's rehabilitation unit, in a hospital's outpatient clinic, or in a rural health center that is operating under the hospital's license

Patients with Insurance and Concurrent CHP+ Enrollment


HCPF recently received a question regarding patients who have private health insurance but are still showing as CHP+ members due to the continuous enrollment requirement under the Public Health Emergency. We have verified with our Eligibility team that providers would be unable to bill CHP+ for these patients due to having private health insurance.


In this situation, the member could report the other healthcare coverage on their renewal; however, there is also the chance that their case will re-enroll in the ex-parte process and they wouldn't get a renewal. 


The member could also contact their local county Department of Human Services to report their other insurance, or submit a change report on Colorado PEAK and request to opt-out of CHP+. At that point, the case would be re-run for eligibility to determine if they are eligible for any other program, and if they are terminated from CHP+, they could move forward with another option such as CICP or Hospital Discounted Care.

Updated PDF Application


A new version of the PDF Uniform Application is now available on the Hospital Discounted Care website.


Providers may post this new version of the application on their website in order to meet the posting requirements.


This new version mirrors the change recently made to the Uniform Application to remove the CICP only statement about applicants refraining to sponsor an immigrant. This change is due to the passing of House Bill 23-1117.
