Forms Changes
Coming October 3, 2022
This newsletter includes important information about upcoming form changes, including: Legal Bulletin 222 from NWMLS and a redlined Purchase & Sale Agreement along with sample copies of other forms offered (e.g. 1ASWF-Exclusive Sale & Listing Agreement, 41-Exclusive Buyer’s Agency Agreement and 41C-Buyer Brokerage Firm’s Compensation Addendum). 
 
Please note that your SAR Exclusive Right to Sell and Buyer Representation Agreements are not changing at this time. 

Your local Forms Committee will be looking at a few possible changes in the future.
The revised Form 21-Purchase and Sale Agreement, along with other NWMLS forms, are being released on October 3, 2022.

There are significant revisions to the Purchase and Sale Agreements. 
Legal Bulletin 222, which summarizes the forms revisions, redline Purchase and Sale, and SAMPLE versions of the revised forms are linked below for review purposes:

Opportunity to Testify at
City Hall Monday night.
The Spokane City Council will be hosting a hearing this Monday night on the emergency zoning and building changes it has passed.

We could use all the voices we can get to help support these efforts.
 
Testimony sign up is open from 5:00-6:00 p.m. on Monday, August 29, 2022.

You must sign up by 6:00 p.m. to be called on to testify.

Sign up forms will be available outside of Council Chambers for in-person attendees.

  • Spokane is facing its most critical housing crisis.

  • Opportunities for workforce or entry level income homes are needed immediately
  • These zoning and building changes are a great first step towards solving this problem
  • No neighborhood value was ever hurt from building new homes people buy

Dies in Airplane Accident
Sandy Williams, a long-time partner of the Spokane Association of REALTORS®, died this week in an airplane accident near Whidbey Island.

Sandy was founder/editor/publisher of the Black Lens newspaper and executive director of the Carl Maxey Center.

The SAR named Sandy its 2019 Citizen of the Year; Washington REALTORS® named Sandy its 2020 Citizen of the Year (pictured) - the first year of the pandemic, therefore the masks.

The SAR was in the middle of planning a Spokane home-ownership event with Sandy at the Maxey Center for the fall - those plans will continue in her memory.

Rob Higgins - the association's executive vice-president - participated in his last board meeting, this week, as he retires from 37-years at the SAR.

The board celebrated the occasion with lunch and cake (pictured) - followed by a round of singing "For He's a Jolly Good Fellow."

Rob's successor - Tiffany Claxton - will begin her role as Chief Executive Officer of the association on September 19th.

New DOL Mandatory Education – Fair Housing Requirements
Effective: June 1, 2022
Effective June 1, 2022, the WA Department of Licensing (DOL) has implemented SB 5378.
 
This bill requires ALL Brokers and Managing Brokers to take a Fair Housing class.
 
Brokers and Managing Brokers licensed BEFORE June 1, 2022, will be REQUIRED to take the Washington Real Estate Fair Housing (6-hr)” before June 1, 2023.
 
New agents licensed AFTER June 1, 2022 will be REQUIRED to take the “Washington Real Estate Fair Housing (3-hr)”.
 
Each subsequent renewal will REQUIRE a 3-hour Fair Housing Class. Just like Current Issues in Washington Residential Real Estate, this 3-hours will be INCLUSIVE of your regular 30-hours required for each renewal.
