ATTORNEY GENERAL NEWS
The Attorney General Alliance & Conference of Western Attorneys General (CWAG): Western Attorneys General Litigation and Action Committee (WAGLAC) hosted the 2023 Winter WAGLAC Meeting in Santa Fe, New Mexico on February 22-23, 2023. The Winter Meeting commenced on February 22nd and continued with a day and a half of substantive and thought-provoking roundtable discussions, in addition to legal seminar with presentations on Texas v. New Mexico, Gold King, and PFAS litigation. The conference was informative and the attendance of WAGLAC members was greatly appreciated. We look forward to continuing the conversation in Palos Verdes, California in June of this year.

COMMENT LETTER
Maryland Attorney General Anthony Brown and New York Attorney General Letitia James led a coalition of 16 states making comments to the U.S. Department of Transportation's Pipeline and Hazardous Materials Safety Administration. The comments expressed opposition to a company's request for a special permit to ship cryogenic liquefied ethane by rail.
WATERS OF THE UNITED STATES
West Virginia Attorney General Patrick Morrisey, North Dakota Attorney General Drew Wrigley, Georgia Attorney General Chris Carr, and Iowa Attorney General Brenna Bird co-led a coalition of 23 states filing a lawsuit challenging the U.S. Environmental Protection Agency’s (EPA) newly published final rule redefining the Waters of the United States (WOTUS).
DATA BREACH
Ohio Attorney General Dave Yost and Acting Pennsylvania Attorney General Michelle Henry announced a settlement with a DNA testing company after a data breach exposed personal data of citizens of both states.
U.S. FOOD AND DRUG ADMINISTRATION
New York Attorney General Letitia James led a coalition of 22 state attorneys general in the filing of an amicus brief in Alliance for Hippocratic Medicine v. U.S. Food and Drug Administration. Joining New York were attorneys general from California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, North Carolina, Oregon, Pennsylvania, Rhode Island, Washington, Wisconsin, and Washington D.C.
Mississippi Attorney General Lynn Fitch led a coalition of 22 state attorneys general in the filing of an amicus brief in Alliance for Hippocratic Medicine v. U.S. Food and Drug Administration. Joining Mississippi were attorneys general from Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Montana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, and Wyoming.

Connecticut Attorney General William Tong led a bipartisan coalition requesting that the United States Supreme Court to protect publicly funded programs from fraud by altering the Connecticut False Claim Act (FCA) that was signed into law in 2009.
California Attorney General Rob Bonta announced the results of a multi-jurisdictional effort - Operation Better Pathways - focused on combating human trafficking and sexual exploitation.
Arkansas Attorney General Tim Griffin made comments following the United States Supreme Court’s decision to decline to review an en banc decision of the United States Court of Appeals for the Eighth Circuit which upheld Arkansas’s law prohibiting national origin discrimination.
Arizona Attorney General Kris Mayes announced an antitrust investigation of the proposed merger between two supermarket chains.
New Jersey Attorney General Matthew Platkin announced that "80 hospice and long-term care facilities will receive drug disposal bags. The bags will provide the facilities with a safe and easy way to dispose of leftover medications, preventing opioids from being diverted or misused after they are no longer needed for a patient."
"Attorney General William Tong and a bipartisan coalition of legislators today announced new proposed legislation to strengthen Connecticut’s ability to fight obnoxious and intrusive robocalls. The legislation would modernize the state’s anti-robocall statutes to match new tactics and technology used to inundate Connecticut households with relentless, unwanted calls."
