Industry Updates:

Banning Boilers: An Analysis of Existing Regulations to Phase Out Fossil Fuel Heating in the EU – Sibylle Braungardt, Benedikt Tezak, Jan Rosenow, Veit Bürger - Renewable and Sustainable Energy Reviews – “With heating in buildings accounting for a large share of the energy consumption in the EU, policies to phase-out fossil fuels for heating and to switch to renewables are key elements. In the context of the proposed actions to phase-out fossil fuels at EU level, this article provides a systematic analysis of current and planned phase-out regulations for fossil fuel boilers in the EU Member States.” Link to paper highlights and abstract here.


NY Code Council Urged to Come Through on All-Electric Buildings – In the legislative process of adopting the state budget, Governor Hochul and the Legislature mandated the end of fossil-fuel combustion in new buildings in New York starting with residential new construction in 2026. The NY Fire Prevention and Building Code Council, which meets quarterly, is now tasked with integrating this initiative in New York’s Building and Energy Codes by the end of the year. On June 23rd the Code Council heard public comments from more than 30 representatives of a wide range of organizations on the importance of effectively carrying out this mission in order to allow NY to meet its climate goals. The Council will be watched closely as it releases successive drafts of the 2024 Codes.

Climate Nexus Annual Gas Survey – Wonder what Americans are thinking about energy issues? This survey is a good place to start. For example: “Methane is viewed much more negatively than ‘natural gas’ and most Americans don’t know that gas contains methane. About half of Americans support policies and investments to transition away from gas.” Survey link here.


National Fuel Gas Projects a Taxpayer Bailout – April 18th Reply Comments of National Fuel Gas Distribution Corporation – As part of a Public Service Commission mandated process, NY’s gas utilities are currently filing Long Term Plans (LTPs) which must be consistent with New York’s Climate Law. National Fuel Gas was the first utility to file and their plan is being examined by Commission staff and other stakeholders. In response to comments by the Natural Resources Defense Council, the company offered the following: “Based on Synapse’s analysis of National Fuel’s LTP, NRDC argues that the LTP is not financially viable. According to Synapse, National Fuel’s LTP will lead to customer rates more than doubling from 2023 to 2050, which will encourage customers to leave the gas system to save money, which in turn will increase costs for the remaining customers so that National Fuel can recover its fixed costs…. National Fuel disagrees with Synapse’s and NRDC’s conclusions, which rely on a false narrative.  The Synapse modeling is fundamentally flawed because it unrealistically assumes that all costs will be absorbed by remaining gas customers.  To address affordability concerns and/or stranded assets, costs associated with New York’s energy transformation will necessarily need to be shared by some combination of taxpayers and electricity customers.”  See page 63 of Item #19 filed 2023 04 18 here.



Pace of Progress Needed to Meet Climate Goals – “Rewiring America has put together our first Pace of Progress report, mapping the current state of the market against what needs to be true in order to meet our emissions targets by 2050. In this report, we establish the national benchmark for the machines we need to electrify in our homes. The upshot? We have a gap of 14 million machines over the next three years above baseline market adoption projections. These first years are critically important as they will define the ramp of adoption over the next twenty years. The faster we move now, the more readily we will achieve our goals.” Article link here.  


NY Lawmakers Passed Nearly 900 Bills. Now It’s Gov’s Turn to Act. – Jon Campbell – Gothamist – “This year, 896 bills cleared both houses of the state Legislature — each of which was the product of some level of negotiation between the Senate and Assembly, which wrapped up its work on Wednesday.  The most consequential talks, however, are yet to come. Over the coming six months, Gov. Kathy Hochul’s office will examine each bill to determine whether she will sign them into law or veto them.  But those aren’t her only options.  Under long-standing New York tradition, governors can — and often do — present lawmakers with an ultimatum: agree to make changes to a bill after the fact, or face a gubernatorial veto.” Among the bills that will be subject to this process is S6604/A6949, designed to make it less burdensome and expensive to drill geothermal boreholes deeper than 500 feet. NYC’s Aging Gas Infrastructure - Leaking Pipes Can Lead to Loss of Service – June Kim – Inside Climate News – The number of New Yorkers reporting gas odors hit an all-time high last year. For lower income residents, the costs of repairing leaking pipes can result in gas service disconnection, leaving residents without gas service for months or even years. Manhattan recorded the highest number of complaints per person. The city, which is aggressively pushing for a clean energy transition, is caught between its effort to move away from fossil fuels and coping with a deteriorating gas infrastructure. Those who cannot afford the transition are bearing the brunt. The Inflation Reduction Act includes tax incentives to install electric appliances such as induction stoves and heat pumps. However, state and local governments have been slow to create the structure to distribute the funds to people. Article link here


Opposition Mounting to Proposed NYSEG Rate Increases – Aubren VillasenorThe Ithaca Voice – “New York State Assemblywoman Anna Kelles hosted a press conference Thursday (6/15) outside the Tompkins County legislative building in opposition to the proposed New York State Electric & Gas (NSYEG) rate increases…Opponents have particularly seized upon the electricity increases, with Kelles’ office, among others, arguing that the compound effect of three years of such increases means a 62 percent increase over three years, while the company has stated that the overall increase over three years would be closer to 22 percent, adding together each year’s percentage increase."  Article link here.


2023 Most Prolific New York Legislators - By Shantel Destra and Eric Holmberg City & State – “Assembly Member Amy Paulin topped the list of lawmakers who’ve passed the most bills in the 2023 legislative session. After several years leading the pack, Paulin said this feat didn’t come as a surprise. ‘I've been at the top of the list for quite a few years, so I've gotten used to it,’ Paulin said in an interview with City & State. State Sen. Brad Hoylman-Sigal – who topped the list in the Senate – was ecstatic at his accomplishment. When asked which bill he was most proud of, Hoylman-Sigal likened it to ‘choosing my favorite child.’ He added: ‘But I do think that the bills that help protect the most vulnerable New Yorkers are the most meaningful.’ ” The article includes a listing of the top ten sponsors of bills passed in each house of the Legislature. (from 2023 06 18 – City & State First Read) Article link here.

Federal $ May Boost Industrial Heat Pumps (IHPs) – Andrew Hoffmeister, Neal Elliott – American Council for an Energy Efficient Economy (ACEEE) - “IHPs can help decarbonize low- and medium-temperature processes in sectors including food and beverage, pulp and paper, and chemicals, and in the production of other goods, such as electric vehicles and batteries. They’re increasingly common in other parts of the world but have yet to gain traction in the United States. Today most IHPs are manufactured and used in Europe and Japan, but recent initiatives by the Biden administration are set to boost domestic production, which should help ensure availability. IHPs can significantly reduce operating costs for industrial facilities." Article link here.


Rewiring America on Electrification – Michael Hernandez - Rewiring America - On June 21st, the Sierra Club Niagara Group hosted a 35-minute wide-ranging presentation titled “Electrify Everything”. It was given by Michael Hernandez, the New York Policy Director for Rewiring America and formerly a lead negotiator for the NY Assembly on the Climate Leadership and Community Protection Act. This presentation provides a good basic introduction to the current state of New York’s efforts to electrify its economy in order to meet climate goals.  Thanks to Niagara Group Chair Janet Lenichek for hosting this session and providing this tip. Con Edison Battery Storage Project is Ready – Maria Gallucci – Canary Media – “Con Edison said it’s about to begin operating a 7.5 MW battery system in Staten Island as New York grapples with grid reliability concerns and rising power demand…The system includes 11 Tesla Megapacks, each of which contains 19 battery modules and its own inverter."  Article link here.


EVs Would Reduce Air Pollutants – Maria Virginia Olano – Canary Media – “Outside of catastrophic wildfire events like the one last week, on average, the leading sources of unhealthy air in the United States are fossil-fuel-powered transportation and electricity generation.” According to a report from the American Lung Association, a national shift to 100 percent new sales of zero-emissions passenger vehicles by 2035 and medium- and heavy-duty trucks by 2040, coupled with a carbon-free grid, would greatly reduce concentrations of pollutants, such as particulate matter, VOCs, NOx and SO2, in the air. For example, the reductions would equate to over $1.2 trillion in public-health benefits." Article link here.

4.6 Million Americans Live Near an Orphaned Well Physicians, Scientists & Engineers for Healthy Energy - “Research has shown that oil and gas wells contribute to air and water pollution, with nearby communities often bearing the greatest impact. Orphaned wells lack a financially responsible party to plug them and financial responsibility is often placed on the public as a result. A new study from researchers at McGill University and PSE Healthy Energy provides tools to help identify where orphaned oil and gas wells pose the greatest climate and environmental risks. Based on data from 81,857 documented orphaned wells across the United States, the researchers estimate that 4.6 million people live within 1 km of a documented orphaned well—a distance deemed higher risk by scientific experts.” Article link here.


NY Passes Ban on Dumping Radioactive Waste in Hudson River – Rosemary Misdary – Gothamist – “The ‘Save the Hudson’ bill — a New York measure that prohibits the dumping of radioactive waste into the Hudson River — is one step closer to becoming a law after passing a special session of state Assembly Tuesday evening. The 100 to 44 vote for passage came after an avalanche of community momentum and unanimous passage through the State Senate last week. But even if Gov. Kathy Hochul signs the measure into law, implementation could prove challenging because nuclear facilities and their waste management usually fall under federal law.” Article link here.

Climate Updates:

Blackouts Predicted this Summer - Nathaniel Scharping – Eos - This summer, as much as two thirds of the United States could be in danger of electricity outages should temperatures drift higher than normal, according to a forecast by the nation’s electrical grid oversight body. A drop in electrical generation capacity as older coal-fired plants are retired and a general shift toward a more electrified society play a role in taxing the supply of electricity. But the biggest factor in recent years is weather, said John Moura, director of reliability assessment and performance analysis at NERC (North American Energy Reliability Council)… Most studies forecasting longer-term temperature trends estimate that it will only get hotter, and heat waves will become more common as climate change heats up the globe. One recent study estimates that the number of days above 100°F (38°C) in the United States each year will double and the number of days above 105°F (41°C) will triple by midcentury compared to the end of the 20th century. Article Link here.

What We Can Learn from the Canadian Wildfires -  IIlana Cohen – The Nation – “The out-of-control Canadian wildfires are not incidental or anomalous: they are a manifestation of accelerating anthropogenic climate change.” Key take-aways from the fires include: climate change crosses national boundaries, so must solutions; climate change is a world-wide public health crisis - fossil fuel pollution is a major contributor to poor air quality, causing one in every five deaths worldwide; climate change affects everyone, but not equally; and the time for action is now – the smoke and fires present an opportunity to press for governmental action." The Kids Are All Right – Bill McKibben – The Crucial Years – “It got…somewhat less coverage than the imploded sub, but for me the titanic story of the last week was the truly remarkable trial held in Montana over the last ten days—one of the first times that the climate story has played out in an American courtroom.  The plaintiffs were 16 Montana youth, who charged that by continuing to issue permits for oil and gas production, the state was violating its constitution, which was amended decades ago to include this phrase: ‘The state and each person shall maintain and improve a clean and healthful environment in Montana for present and future generations’…We’ll wait a few weeks for the verdict in the case… But no matter the outcome, it was a moment of very high drama” - Article link here.

Canadian Wildfires Dominate Canadian Carbon Emissions - Bill McKibben – The Crucial Years – “According to Marc Lee, senior economist at Canada’s Centre for Policy Alternatives, the massive forest fires across the country have put more carbon into the air than all the driving, heating, cooling, lighting, flying, and other energy combustion that the country will engage in this year.” As of June 14, 5.4 million ha have burned, which translates into 765 Mt of CO2 equivalent. This is larger than total GHG emissions in any year in Canada's inventory (2021 was 670.4 Mt, peak 2007 at 748 Mt)   Article link here. Wildfire Smoke and Asthma in the Bronx – Gina Jimenez – Inside Climate News – “Smoky days can double emergency hospital visits for asthma, which disproportionately affects Black and Latino children. In New York, the Bronx was especially hard hit…(On Wednesday, June 7th) New York City hospitals experienced the highest number of ER visits for asthma-related conditions for all of 2023. That same afternoon, the city was choked by abnormal levels of wildfire smoke from Canada, reaching 366 on the air quality index—24 times the World Health Organization recommended exposure guideline. 2023 06 29 – White House Briefing on Direct Pay and Transferability of IRA Credits - 3:00 pm ET – “The Inflation Reduction Act created two new credit delivery mechanisms—elective pay (otherwise known as ‘direct pay’) and transferability—that enable state, local, and Tribal governments; non-profit organizations, U.S. territories; and other entities to take advantage of clean energy tax credits. Until the Inflation Reduction Act introduced these new credit delivery mechanisms, governments, many types of tax-exempt organizations, and even many businesses could not fully benefit from tax credits like those that incentivize clean energy construction.” Register here

IGSHPA is partnering again this year with NGWA (National Ground Water Association). 2024 05 28th to 30thIGSHPA Research Conference - The International Ground Source Heat Pump Association (IGSHPA) is pleased to announce that the next IGSHPA Research Conference will be held at Polytechnique Montréal. This is the fourth in a series of research conferences held in Denver (2017), Stockholm (2018), and Las Vegas (2022). Like the previous three conferences, papers will undergo peer-review to ensure quality. Details will follow, but it is anticipated that abstracts will be due on September 18, 2023 and papers due around November 20, 2023. Question? Energy Department Will Recruit 1,000 Additional Staffers For New Corps To Tackle The Climate Crisis • The DOE is starting up a Clean Energy Corps to help implement the bipartisan infrastructure law and develop clean-energy solutions to the climate crisis, the agency said.
