Amendments - Why Vote Yes??
The Board has proposed some important amendments to the Bylaws and Declaration of the POA which will make POA operations more efficient and effective.
The three amendments are listed below with a brief description of each and why you should support these amendments by voting yes on the various changes.
Amendment to the Jonathan’s Landing Restated Declaration of Covenants and Restrictions
Article VII Section D of the Declaration be amended to provide for collection of 2 quarters of Capital Contribution instead of 1 quarter at each new closing
Why is this important?
- Funds collected are directed to fund Reserves and Capital Projects only
- Affects new real estate sales only and does not impact existing owners
- Excludes present owners who change the name on the title to their home for estate planning purposes from this collection
Amendment to Article IX of the Design Control Board
Remove the requirement to have a Board Member as a member on the Design Review Committee
Why is this important?
- If the DCB decision is appealed, the decision is then brought to the Board for hearing, providing that the Board member has voted twice on the subject area
- Committee chair reports as part of the monthly Board meeting ensuring Board is aware of any key topics or issues
- Large time commitment by Board member detracts from other Board responsibilities
Amendments to Article III of the restated Bylaws
New provisions for the election of Board Members
Why is this important?
- Remove nominating committee which is no longer required under Florida Law
- Provide guidelines on the election of Directors
- Provide the election of the candidates by ballot
- Remove the requirement to allow nominations from the floor for the annual election of Directors
