TOKI's Development Agreement
Kiawah Resort Associates
On November 1, 2022, The Town of Kiawah Island Town Council, with opinions from its legal counsel, Joe Wilson, and Ross Appel, approved a fourth amendment to the 2013 amended and restated development agreement (ARDA) with Kiawah Resort Associates (Kiawah Partners). The fourth amendment shortened the term of the 2013 ARDA from January 1, 2026, to December 4, 2023.

By shortening the term, it was the Town’s intent to bring the 2013 ARDA into compliance with the South Carolina Local Government Development Agreement Act, which states that “development agreements involving property containing one thousand acres or less of highland but more than two hundred fifty acres of highland shall be for a term not to exceed ten years.” The 2013 ARDA was entered on December 4, 2013, so the ten-year limitation imposed by state law required that the agreement terminates on or before December 4, 2023. The fourth amendment also clarifies that Town ordinances in place on December 4, 2013, were the ordinances that applied to all properties covered by the 2013 ARDA. It is important to note that nothing material will change because of the Town Council’s decision to approve a fourth amendment to the development agreement.

Kiawah Island Golf Resort
The Town of Kiawah Island’s attorneys are currently reviewing the Kiawah Island Golf Resort’s 2010 development agreement and its 2017 first amendment. As the Town continues its due diligence, we will communicate updates with the community as they become available. If you have questions regarding the Resort’s development agreement, please reference our development resource page here or send questions to contact@kiawahisland.org
