PARTNER'S PERSPECTIVE
Austin T. Hamilton - Remembering what matters most.
I love the holiday season. For me, it is not about the presents or material things. The holiday season seems to bring more cheer and promote happiness. I usually find myself reflecting on the year and finding a way to better appreciate life.

Recently, I found myself reflecting on 2022. I thought about the good times and the bad times, the happy times and the sad times. I also thought about what I could do differently to make 2023 a better year for myself, my family, and others.

Overall, the holiday season allows me to remember to be grateful for what I have. I have a wonderful wife, Emily. We have two beautiful boys who are growing up too fast, which reminds me every day how precious life is. Gratitude is important and it can be easily overlooked.

Reflecting on 2022, I think about the great times I have had with my family.  At the end of 2021, I made a goal to spend more time with family. In many respects, I met that goal. However, in other respects, I failed miserably. I have acknowledged those shortcomings and I will work harder in 2023.

One way I set out to spend more time with family was to take more mini-vacations or long-weekends. For example, in October, Emily and I took our boys to Toledo, Ohio to visit family. Without a doubt, if you are ever planning a trip to Ohio (don’t laugh), October is the best month. We spent four days and soaked up as much of the fall weather as possible. We went to at least two pumpkin patches. We picked apples. We ate apple fritters and pumpkin spiced doughnuts. We carved pumpkins. And to top it off, we went to Cedar Point, which is a place I loved growing up and which I wanted to share with my children. Overall, the trip was fantastic, and it was great spending time with family and friends. It also reminded me of what matters most—family.

Most recently, I finally fulfilled my 2021 Christmas present to my dad and took him to Washington, D.C. My older brother, who lives a few hours away, met us in D.C. We spent a long weekend walking the city, viewing monuments, and exploring museums. However, the best part was simply spending quality time with my dad and brother. We laughed a lot, drank even more, and made memories that I will cherish forever.

This holiday season, my goal is to be present, both mentally and physically. I also want to be grateful for what I have and to appreciate time with friends and family. I suggest you take time to reflect on what matters the most to you. Yes, 2022 may have been a difficult year in many respects. Nevertheless, there are many things to be thankful for, including family, friends, and those other parts of life that you cherish. Please take the opportunity to reflect on the impactful moments in your life and pass some gratitude on to your loved ones.

From the Hamilton house to yours, Happy Holidays!
Best Regards,
Austin T. Hamilton

Florida Medicaid Providers Beware: You Must Pay Your Employees At Least $15/Hour

By: Melissa G. Murrin

On June 2, 2022, Governor DeSantis signed the Freedom First budget for the 2022-2023 Fiscal Year, which provided over $600 million in funding to the Agency for Health Care Administration (the “AHCA”). The purpose of the funding is to increase minimum wage to at least $15/hour for employees of Medicaid providers, including 1099 employees, who provide services under the increased reimbursement fee schedules. If those Medicaid providers are not paying their employees at least $15/hour as of October 1, 2022, those providers are at risk of a civil lawsuit by their employees, and a recoupment of funds.

Assignment of Benefits Under Florida Law: Businesses and Insurers Beware

By: James O. Birr

Florida’s assignment of benefits statute affects homeowners and businesses alike, and both parties should proceed with caution when dealing with an assignment of benefits agreement. Indeed, section 627.7152 of the Florida Statutes codifies the requirements for a valid assignment of benefits agreement. See Section 627.7152 of the Florida Statutes.

Important Contract Terms for Every Small Business

By: Austin T. Hamilton

Every small business should have a written contract, whether it is with its customers, vendors, or suppliers. While every business is different, and this may apply to some industries more than others, it is important for small businesses to evaluate when or how a dispute could arise and whether they are protected if that happens. As a litigation attorney, I am constantly presented with disputes and come to find out that the small business did not have a written contract in place. Not having a written contract can make the dispute harder to resolve and more costly for the business.

November JB FOR ME Highlight Reel
The holiday season is upon us, and our calendars are quickly filling up with meetings, appointments, events and more. We take pride in our employees and value the relationships we have developed.

This month we enjoyed showing off our Jaguars pride and indulged in delicious holiday treats including national nacho day, national vanilla cupcake day and our company Thanksgiving potluck. Competition was at an all-time high during the Rock, Paper, Scissors tournament and the Annual Beer Pong tournament. Congratulations to Stephanie Maynard for winning Rock, Paper, Scissors, who looked like she was ready to play Rock, Paper, Scissors, throat punch if she didn’t win. Also, big props to Stewart Subjinski for winning Beer Pong. Stew sinks ‘em, you drink ‘em. Even though he’s getting old, the kid’s still got it.
This time of year it is important to reflect on accomplishments, memories and relationships. We enjoyed a feast at our Thanksgiving potluck where everyone contributed baked goods, casseroles, turkey, ham and desserts. The thing we are most thankful for right now is elastic waistbands.
