A Trail Guide through the Evaluative Mediation Process

This workshop will utilize an actual dispute that was settled in one session of mediation, to highlight some of the features of the evaluative mediation process, addressing such questions as:
  • Why start with a Joint Session, when so many practitioners have moved to proceeding straight into caucusing?
  • How does one initiate a meaningful dialogue about risks and options, so as to provide decision makers with an expanded and refined data set?
  • If the process is not focused on conveying offers and demands, how do you crystallize final settlement decisions?
 
Registrants will receive summaries of the briefs that were submitted to Tony for the mediation - edited for confidentiality.

Tony will walk us through the initial joint session and the first round of caucuses, and will discuss how a mediator's proposal was utilized to finalize the settlement. 

Registrants will have the opportunity to submit questions in advance, and we will break periodically to take questions and comments.
 
From Tony’s workshop, you will learn more about the evaluative mediation process, and leave equipped with a working knowledge of this process option for your own mediation practice.
Antonio Piazza
Antonio Piazza is recognized as one of the leading mediators in the world. Mr. Piazza is a 1974 graduate of the New York University School of Law. He pioneered the development of mediated negotiations as the preferred alternative to protracted conflict in complex civil disputes, having successfully mediated the resolution of more than four thousand cases since 1980. These have included some of the most complex, high stakes and high profile disputes in the commercial sphere. They have involved the world’s preeminent companies, business leaders, and law firms, and have routinely reached resolution in a single day of mediated negotiations. Individual settlements have exceeded one billion dollars.
