Topic: New law regarding meal and rest break penalties

Lawsuits and PAGA penalty actions continue to be filed against car dealerships based on meal and rest period violations, which involve both whether the meal and rest periods are provided, and what penalty applies if they are not provided, including how to calculate that penalty. Since 2001, employees who are not provided with legally authorized meal and rest periods are entitled to one hour of pay at their regular rate of pay. Under a recent decision (Farra v. Loews Hollywood), the court made clear that this “regular rate” must include all compensation attributable to the work week when the violation occurred, not merely a base hourly rate. Most importantly, as long as meal periods and rest periods are “provided” or made available, employers are not always liable for deviations related to meal and rest periods that are caused by employees rather than the employer.

This seminar will do an expedition into the current state of the law regarding meal and rest periods (and recovery periods), related history, and how to avoid violations and exposure.
