Greetings!

It is misty and cool outside as I type this, signalling that Fall weather and Gaslight and Middletown Festivals are happening soon!
In this newsletter I will discuss District 36 issues, legislation, road plans, and political topics, and there are many "hot links" to additional information. Please forward to your neighbors who might have interest; you can subscribe or unsubscribe at any time.

I will do my best to answer questions and consider your input on District 36 issues if you would like to contact me.

Shelbyville Road Corridor Projects
There is a lot of development and congestion in the US 60 area, and two critical projects are in design phase to help:








KY 155 @ Pope Lick Interchange: there are 3 projects on KY155 from I-265 on into Spencer County. Property acquisition and design are in progress. Highway Dept has a pretty cool 3D "Virtual Reality room" to explore here.


Other large projects now funded and in planning/design in or near Dist 36:
As status progresses on these projects, I will provide more detailed updates.
Please continue to advise me on the most critical un-addressed road issues in your area.The Legislature has a role in prioritizing State road projects based on critical needs, safety and congestion. I work with our Metro council on local road issues and joint projects.
Constitutional Minute
Constitutional Privacy Guarantees
Personal privacy is well protected in both the KY and US Constitutions, but it is up to the People, the Legislature, the Attorney General and the Courts to see that these rights are respected. Freedom requires eternal vigilance!
US Constitution Amendment 4:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” (1787)

KY Constitution (Section 10): Security from search and seizure -- Conditions of issuance of warrant.
The people shall be secure in their persons, houses, papers and possessions, from unreasonable search and seizure; and no warrant shall issue to search any place, or seize any person or thing, without describing them as nearly as may be, nor without probable cause supported by oath or affirmation.” (1891)
Legislative Update
2022 Senate Bill 176 – Facial Recognition Technology – this bill created a KY working group with law enforcement groups and other government agencies to develop a model policy on use of facial recognition technology by January of 2024.
Why should we care? Well, among other things, it will determine how to use facial recognition technology as probable cause for arrest, and prohibit using it for Constitutionally protected activities in public spaces – but the “devil is in the details” as they say, and I will be keeping an eye on this. Based on recent events, I tend to not trust government with increased surveillance powers.   Please let me know your thoughts on this, as the next legislature may take action based on the working group report.
Political Happenings in Dist 36
Landowner Privacy Proposal
Many residents of the more rural parts of District 36 have several acres of land around their homes. Most are surprised to find that current law does not prevent law enforcement agencies from putting surveillance cameras in those woods without permission or notification. Sound like a violation of the 4th Amendment?? I think so too. Read what happened to a Tennessee landowner who removed a "mystery camera" in his woods in this news article. That landowner won his lawsuit vs State of Tennessee, that paves the way for some law changes.
In the 2023 Session, I plan to introduce a Landowner Privacy Bill [read more] to proactively address this in KY law and guard our privacy.
I plan to execute on all my campaign promises (see highlighted above), and I expect you the voters to hold me accountable.
