The Business Tax Burden in Washington is Above the National Average | |

State business and occupation (B&O) tax collections are up 258% since 2000. But businesses also pay sales, property, and many other state and local taxes. Indeed, businesses paid 49.7% of total state and local taxes in Washington in fiscal year 2022, according to a report from the Council on State Taxation. (Nationally, businesses paid an average of 44.6% of state and local taxes.)
Washington businesses paid $10,100 in state and local taxes per employee. This was the 11th highest amount among the states, and 18.8% above the $8,500 average paid nationally. Meanwhile, according to the Tax Foundation, Washington’s tax competitiveness is the sixth worst in the nation.
Washington businesses face a heavy tax burden compared to businesses in other states. Taxes are not the only factor for businesses deciding where to set up shop, but they are part of the consideration. Washington’s competitiveness will worsen if the business tax burden continues to grow.

WA Passes Natural Gas Initiative | |

Washington voters approved Initiative 2066, a measure that explicitly protects access to natural gas in Washington, and also weakens building codes that make it more difficult and costly to add natural gas heating in new construction.
The initiative marks a moment when the state, long known for its progressive climate policies, has taken a step in the other direction. It throws a wrench in the state’s long-term plans to ease reliance on climate-warming fossil fuels, and Washington now joins dozens of other states that have passed similar laws prohibiting local bans on natural gas.
As of Friday, about 51.4% of ballots favored Initiative 2066, a lead of about 90,000 votes. The Seattle Times called the contest. But this might not be the end of the fight, as opponents are preparing a legal challenge they intend to file after the election is certified.

AWB Reflections on 2024 Election | |

Energy choice: Initiative 2066 prevailed in last week’s election, signaling that voters understand the critical role natural gas plays in our economy. AWB endorsed the initiative, which repeals the State Energy Code.
Two other AWB-endorsed initiatives failed, including I-2109, which would have repealed the state’s capital gains tax, and I-2124, which would have given Washingtonians the ability to opt out of the state’s long-term care insurance program.
Change in leadership: Washington voters also selected the first new governor in 12 years. Bob Ferguson will be sworn in as the state’s next governor on Jan. 15.
“The employer community looks forward to engaging with Gov.-Elect Ferguson and finding ways to improve Washington’s business competitiveness,” AWB President Kris Johnson said. “This is a state of entrepreneurs, innovators and makers. If we make smart choices, we can avoid falling behind other states and regions and fuel a new era of prosperity for everyone, in every part of the state.”
Other races: Voters agreed with AWB’s endorsement of Lt. Gov. Denny Heck, Secretary of State Steve Hobbs, Auditor Pat McCarthy and attorney general candidate Nick Brown. The vast majority of the candidates AWB endorsed for the state House and Senate also prevailed.
Even so, Johnson said employers held some concern about the continued strengthening of a one-party majority in Olympia.
What’s next: Last Thursday, former Republican legislator Paul Graves and Democratic strategist Sandeep Kaushik joined AWB Vice President of Government Affairs Dave Mastin to discuss the potential impacts of local and state election results on the employer community in AWB’s 2024 post-election webinar.
Bucking the trend: Unlike most of the rest of the country, Washington did not swing to the right this election. That means employers may be facing familiar issues in the next legislative session.
“Some of the policies that almost passed last session that were Democratic priorities are probably now going to be firmly on the table,” Graves said. “Those include rent control, hospital mergers and unemployment benefits for striking workers.”
A budget battle: Graves and Kaushik agreed that the Democratic majority may feel emboldened to raise taxes on businesses in the next session. It’s important for employers to get involved and speak with their legislators about the issues that impact their businesses.
“There are moderate Democrats, and I do think the business community has opportunities to have real conversations with them about what the unintended consequences of some of those choices might be,” Kaushik said.

Minimum Wage Increase Leads
to Other Changes for 2025

Adjustments to minimum wage also mean updates to the 2025 minimum salary thresholds for overtime exempt employees, the minimum pay for rideshare drivers, and non-compete clauses:

Minimum salary thresholds for overtime exempt employees
- Changes how much executive, administrative, professional workers, computer professionals, and outside salespeople must earn in salary to be exempt from overtime requirements.
- For small employers (1-50) in 2025, the minimum salary threshold is $69,305.60/annually
- For large employers (50+) in 2025, the minimum salary threshold is $77,968.80/annually
- Minimum pay for rideshare drivers

Minimum pay for drivers for rideshare companies such as Lyft and Uber is one of the new rights and protections granted to these drivers
- For trips within Seattle in 2025, drivers must earn least $0.68 per passenger platform minute and $1.59 per passenger platform mile, or $5.95, whichever is greater.
- For trips outside of Seattle in 2025, drivers must earn at least $0.39 per passenger platform minute and $1.34 per passenger platform mile, or $3.45, whichever is greater.
- Non-compete clauses
- Non-compete agreements typically prevent an employee or independent contractor from working for a competitor or starting a similar business while employed or after leaving their current job.
- Earnings must meet a minimum threshold for non-compete agreements to be legal in Washington.
- For employees in 2025, the threshold will be $123,394.17
- For independent contractors, the 2025 threshold will be $308,485.43.

Port Seeking Public Feedback on Expansion of Bremerton National Airport | |

Should the Bremerton National Airport have commercial passenger or cargo service? The Port of Bremerton wants to know.
The Bremerton National Airport currently serves only general aviation, corporate jets and military jets. For over a decade the Port, which runs the facility, has heard feedback from different viewpoints. Some people ask for commercial passenger service to be added, and others oppose that kind of expansion.
Jim Rothlin, CEO of the Port of Bremerton, said he had heard such community input since he began living in the area, but was under the impression that commercial carriers weren’t interested in servicing the area. But the possibility of bringing commercial passenger service to Bremerton resurfaced when the state began researching areas, such as Bremerton, to expand services that could lessen the strain at Seattle-Tacoma International Airport.
