State and National Elections Yield Surprise Results
Election night produced surprising results at both the state and federal levels as Democrats bucked strong headwinds and outperformed projections. Led by Governor Walz’s reelection, Democrats ran the table in Minnesota, taking all four statewide constitutional offices and gaining control of both houses of the legislature.

Federal Election Results Remain Unclear
Days after election night, control of Congress remains uncertain but the widely projected national “Red Wave” never materialized. Democrats surprisingly outperformed the traditional mid-term loss projections and several seats in Congress remain too close to call.

The Minnesota construction industry will need to be a strong, united voice next legislative session. Legislators will set the state’s budget, consider regulations, and discuss unfinished business – such as federal infrastructure matching funds and a capital investment bill- from last session. Hear from key decision makers and get an update from AGC of MN’s Government Affairs staff at the beautiful State Capitol on Wednesday, April 12.

US DOT Proposes New Buy America Waivers
The U.S. Department of Transportation is publishing two new sets of proposed waivers from Buy America requirements for federal-aid highway and transit projects. As we have been discussing for the past year, the Infrastructure Investment & Jobs Act (IIJA) expanded Buy America coverage to five categories of construction materials (non-ferrous metals, PVC/plastics, lumber, drywall and glass).
While this coverage was supposed to take effect in May, U.S. DOT delayed it until November 10 (i.e. yesterday). Iron, steel and certain manufactured products remain subject to Buy America as in the past. Aggregates and other pavement-related materials are not covered.
- “Notice That the Build America, Buy America Requirement for Construction Materials Applies Effective November 10, 2022, and Notice of Proposed Waiver of Buy America Requirements for De Minimis Costs, Small Grants, and Minor Components”
- U.S DOT is proposing to waive domestic preference for iron, steel, manufactured products, and construction materials on a federal-aid project if:
- The total value of non-compliant products is no more than the lesser of $1,000,000 or 5% of total allowable costs from the federal-aid funding;
- Federal-aid funding for the project is below $500,000; or
- The non-domestically produced miscellaneous minor components comprise no more than 5 percent of the total material cost of an otherwise domestically produced iron or steel product.

Building Better, Safer Transportation Systems to Reduce Traffic Accidents
The number of U.S. traffic deaths has been steadily increasing. According to the National Highway Traffic Safety Administration, vehicle fatality rates increased by 10.5 percent up to 42,915 last year. Traffic Modeling team mitigate risks, reduces traffic accidents, better protects motorists and pedestrians, and analyzes ways to reverse the deadly trend of motor vehicle crashes. Learn more

Hennepin County Constructability Review
Vernon Avenue Bridge (County Road 58) Reconstruction in Edina
Hennepin County will be conducting one-on-one constructability reviews with prime and/or bridge contractors interested providing input into the development of this project. Items to be discussed at the constructability review include construction access, schedule, staging and risk mitigation.
