Updated CDPH Guidance: Employees with or Exposed to COVID-19

Last week, the California Occupational Safety and Health Standards Board adopted revisions to its COVID-19 Prevention Emergency Temporary Standards, based on updates from the California Department of Public Health. This includes incorporating new protocols for employees who test positive for COVID-19 or are exposed to someone with COVID-19. While you are encouraged to read the full CDPH protocols, here's a summary:

  • Employee Tests Positive, Regardless of Vaccination Status: Stay home for five days. If no symptoms on day 5, get tested on day 5 (or later), and return to work if test result is negative. If employee cannot get tested and has no symptoms, stay home for ten days and return to work when not symptomatic.

  • Employee Exposed, Unvaccinated or Non-Boosted: Stay home for five days. Get tested on day 5 (or later), and return to work if test result is negative. If employee cannot get tested, stay home for ten days and return to work if not symptomatic.

  • Employee Exposed, Boosted: Continue working. Get tested on day 5 to confirm non-infection.

COVID-19 tests have been difficult to obtain in recent weeks, but help is on the way! Starting the week of January 17, the County of Ventura and State of California are adding multiple testing facilities within Moorpark to help meet demand for testing, in addition to the existing sites at Moorpark College, Moorpark High School, and Chaparral Middle School. All state and county testing facilities offer PCR tests and are completely free.

Claim Your Federal Employee Retention Tax Credits

The Employee Retention Tax Credit (ERTC) is a refundable credit that businesses can claim on qualified wages, including certain health insurance costs, paid to employees. Qualified employers can claim a credit against:
  • 50% of qualified wages paid, up to $10,000 per employee annually for wages paid between March 13 and Dec. 31, 2020
  • 70% of qualified wages paid, up to $10,000 per employee per quarter for wages paid in the first three quarters of 2021

PLUS, “Recovery Startup Businesses” could be eligible to claim a credit of up to $50,000 for the third and fourth quarters of 2021. 

ERTC Eligibility

Employers, including tax-exempt organizations, are eligible for the credit if they operate a trade or business during calendar year 2020 or 2021 and experienced either:

  1. The full or partial suspension of the operation of their trade or business during any calendar quarter because of governmental orders limiting commerce, travel or group meetings due to COVID-19, or
  2. A significant decline in gross receipts. 

To be considered a Recovery Startup Business, one must: 

  1. Have begun carrying on trade or business after February 15, 2020;
  2. Have annual gross receipts that do not exceed $1 million; and
  3. Not be eligible for the ERTC under the other two categories, partial/full suspension of operations or decline in gross receipts.

Recommended Actions

If you already work with a payroll provider: Contact your current payroll provider for guidance.

If you do not work with a payroll provider:
  • EDC SBDC Financial Advisors can provide guidance with the ERTC, including reviewing the program and potential eligibility with small businesses. Call the EDC Business Assistance Line at (805) 409-9159 to get started.
  • Contact a payroll service such as: Paychex or ADP for guidance.

California Competes Tax Credits
