RE:     Remote Online Notarization Expansion
 
The use of technology will enable Agents National Title Insurance Company agents to conduct closings while keeping themselves, REALTORS, lenders, and consumers safer and following CDC, state, and local advisories during the coronavirus social distancing efforts.  ANTIC is issuing this bulletin to provide guidance to our agents to explain our requirements for the expanded use of Remote Online Notarization though April 30, 2020.

  1. Remote Online Notarization (RON) is insurable by ANTIC in these states
  • Florida 
  • Kentucky
  • Minnesota
  • Montana
  • Nevada 
  • North Dakota
  • Ohio 
  • Oklahoma 
  • Pennsylvania
  • South Dakota
  • Tennessee 
  • Texas
  • Utah
2. Remote Online Notarization (RON) is insurable by ANTIC in these states if a RON Notary is used from the above listed states

  • Arizona 
  • Indiana
  • Maryland
  • Kansas
  • Missouri
  • Nebraska
  • Washington

If you have a transaction in a state that is not listed, please consult your local ANTIC underwriting counsel with questions. 

3. Temporary Underwriting Guidelines through April 30, 2020 (All items must be confirmed)

  • Consent to RON: Parties to the transaction must consent to using RON for the transaction by signing the attached consent. This includes approval by a lender, if any. 
  • Closing Instructions:  Lender and other written closing instructions must authorize the use of RON.  If they do not, you must request updated instructions to use this technology.
  • Approved RON Vendor Platforms
  • Notary Commission:  Remote Online Notaries generally have specific commissions and appointments to conduct a remote online notarization. All remote online notarizations must be conducted by a remote online notary commissioned in that jurisdiction and the notary must be located        within that jurisdiction at the time of notarization.
  • Signer location:  The person whose signature is going to be notarized must be within the United States.  If the person is outside the United States, please contact local underwriting counsel for authority.
  • Signer citizenship:  The person whose signature is going to be notarized must be a US Citizen or a permanent resident.
  • County Acceptance of RON electronic documents for recording:  The county offices where the property is located must be able to accept and process a RON electronic document.
    • Note:  If the property is located within Florida, Idaho, Montana, Minnesota, Ohio, Oklahoma, Tennessee, or Texas, you may paper out (print to paper) the documents for recording per state statute.    
  • Transaction Amount Limit: These transactions are limited to your Overlimit approval amount.  Please contact underwriting for authority to conduct a closing over this.
