Oppose Amendment to SB 266 
Home-Based Businesses Preemption
SB 266 (Perry) will be considered by the Senate Commerce and Tourism Committee today at 3:30 p.m. ET.
A late-filed amendment (barcode203018) has been filed to SB 266 that would “undo” several provisions that would give cities tools to regulate home-based businesses to ensure they do not adversely impact their neighbors and their community.

Please contact Senators on the Senate Commerce and Tourism Committee ASAP and urge them to Oppose Senator Perry’s Late-filed amendment to SB 266
The late-filed amendment would do the following:
  • Remove a provision that requires a home-based business to be consistent with the residential character of the dwelling unit.
  • Weaken a provision for the detection of noise, vibration, heat, smoke, dust, glare, fumes, or odors.
  • Weaken provisions allowing local governments to regulate parking at home-based business.
  • Restrict the ability of cities to restrict hours of operation between 8 a.m. and 8 p.m.

FLC is neutral on SB 266 without the late-filed amendment. Please oppose the late-filed amendment.
