FINAL IRS 2020 FORM W-4 RELEASED

On December 5th, 2019 the IRS released the final version of the 2020 W-4 form

***iSolved and Efficient Forms has already built in the logic for the new W-4. The new form will be ready for on-boarding on Jan, 1 2020.

Here are the major changes:

# of withholding's are now eliminated

New Marital Status-Head of Household

No more lines to fill in for claim exemption

As previously announced, existing employees will not be required to complete a new Form W-4 for 2020.Employers will continue to observe the withholding preferences and filing status pre- 2020 W-4.

Employees hired after January 1st 2020, are required to fill out the new form W-4.

California Delays Employer Sexual Harassment Training Requirements to 2021

On September 30th, 2018, California lawmakers passed SB 1343 intended to curb sexual harassment in the workplace in the wake of the #MeToo movement. This law required employers with 5 or more employees (including temporary and seasonal) to provide at least 2 hours of sexual harassment training to all supervisors and at least 1 hour to all non supervisory employees by January 1, 2020.

Here is the reprieve:

On August 30th, 2019, Gov. Gavin Newsom signed SB 778 which delays employer sexual harassment requirements originally established in 2018 to January 1, 2021

Here is what you should know:

All employers with 5 or more employees must provide at least 2 hours of sexual harassment training and education by 1/1/2021, and thereafter every 2 years.
All new (non supervisory) hires must complete sexual harassment training within 6 months of hire.
All new supervisory must complete sexual harassment training with 6 months of the assumption of a supervisory position.

YOUR EMPLOYEE RECORD KEEPING REQUIREMENTS CHECKLIST FOR 2020

A number of federal, state and local laws dictate which records employers must retain and for how long. Here's a checklist to help you "clean up" your employee document retention practices for the new year.

Are your personnel files complete? Generally, personnel files should contain onboarding documents (offer letter, resume, application). Any policy/Employee Handbook acknowledgements. You should also keep copies of performance review or disciplinary actions taken against the employee.

Are your employees medical related documents stored separately? Since the inception of The HIPAA act of 1996 all employees medical records are to be stored separately from the general personnel file.

Do you have a completed W-4 and I-9? Employers must complete and retain an I-9 for EVERY employee hired in the United States. These must be retained for 3 years or for 1 year following separation(whichever is later).
