CITY OF FOSTORIA
Renewal Levy - a tax for the benefit of the City of Fostoria for the purpose of current expenses at a rate not to exceed six (6) mills for each one dollar of valuation, which amounts to 60 cents ($0.60) for each one hundred dollars of valuation, for 5 years, commencing in 2022, first due in calendar year 2023

Fostoria Charter Amendment: Changes form of Government - The Amendment to the Charter of the City of Fostoria changes the form of government of the City of Fostoria from a Council-Mayor Government to a Council-City Manager Form.

The amendment shall replace the current Article IV, remove current Article V,5.04(B)&(C), add a new Article V and renumber all successive Articles accordingly, replace any mention of “President of Council” elsewhere in the current Charter with “Mayor/President of Council”, replace any mention of “Mayor” elsewhere in the current Charter with “City Manager”, replace “Mayor-Council” with “Council-Manager” in current Article I, 1.02, remove the second sentence which reads: A separately elected President of Council, in addition to the number of Council Members elected, shall exercise those powers and perform those duties and functions as provided by the General Laws of Ohio.” In current Article III,3.01(B)(I), delete the words “and the person elected as the President of Council” in Article III,3.01(B)(3), and delete the words “or decreased” in the current Article III, 3.06.

Fostoria Charter Amendment: Director of Finance - The Amendment to the Charter of the City of Fostoria shall replace current Article V, 5.02 and repeal the current Article V, 5.03 shall read as follows.
ADMINISTRATIVE DEPARTMENTS
5.02 Director of Finance
(A) The Department of Finance shall be under the supervision, direction, and control of the Director of Finance, who shall be an elector and shall meet the qualifications as described in the job description which is to be developed by City Council. The Director of Finance shall be appointed by City Council by majority vote and for an indefinite term. He or she may be removed by City Council by majority vote.
(B) The Director of Finance shall be the chief fiscal officer of the City and shall perform the powers, duties and functions now or hereafter given to City Finance Directors by this Charter and the General Laws of Ohio. The Director of Finance shall have other powers, duties and functions as provided by ordinance or resolution. The Director of Finance shall keep the financial records of the City; establish the accounting systems, financial records and reports used by the offices, departments, divisions, bureaus, boards and commissions of the City; prepare and submit the budget and appropriation matters; provide full and complete information concerning the financial affairs and status of the City as requested by Council; and provide full and complete information and assistance concerning the finances or accounting systems or records of any office, department, division, bureau, board, or commission of the City as requested by Council.
(C) Council shall conduct an annual performance review within thirty (30) days of the anniversary of the appointment of the Director of Finance.

Fostoria Charter Amendment: Director of Law - The Amendment to the Charter of the City of Fostoria shall replace current Article V, 5.01 and shall read as follows:

ADMINISTRATIVE DEPARTMENTS
5.01 Director of Law
(A) The Department of Law shall be under the supervision, direction, and control of the Director of Law, who shall be appointed by City Council by majority vote and shall serve for an indefinite term. He or she may be removed by City Council by majority vote. He or she shall be the appointing authority for the Department of Law
(B) The Director of Law shall be an elector and shall be an attorney-at-law duly authorized to practice law in the State of Ohio.
(C) The Director of Law shall be the legal advisor, prosecuting attorney and counsel for the City, and subject to the direction of Council, shall represent the City in all proceedings in Court or before any administrative board or body. The Director of Law shall perform all other powers, duties, and functions now or hereafter imposed on Directors of Law under the laws of Ohio and shall perform other duties as required by this Charter, by ordinance or resolution, or as directed by the Council.
(D) The Council may provide for assistants to the Director of Law. All assistants shall be appointed by the Director of Law. The assistants shall be responsible to the Director of Law and when authorized by the Director of Law, may exercise all or any part of the powers, duties, and functions authorized by and in the manner provided by the Director of Law or the Council.
(E) Council shall conduct an annual performance review within thirty (30) days of the anniversary of the appointment of the Director of Law.
The Fostoria Chamber of Commerce Board of Directors endorses the proposed changes to the Charter. (Vote cast at regular board meeting on September 16, 2021)
