Osha Liang LLP Announces Name Change to Osha Bergman Watanabe & Burton LLP

We are excited to share some important news with you. As of October 1st, 2020, we are rebranding. Our U.S. firm will change its name from Osha Liang LLP to Osha Bergman Watanabe & Burton LLP (OBWB). Following Dr. Liang's retirement in 2016, the firm has decided to recognize the outstanding and longstanding contributions of Managing Partner Jeffrey Bergman and Partners Yuichi Watanabe and Carlyn Burton. This change of name is a celebration of who the firm is today, not a reflection of any change in management or leadership. As always, our commitment to serve you remains the same. The Jury is "In" On Standard Essentiality 

As recently explained by the Court of Appeals for the Federal Circuit in Godo Kaisha IP Bridge 1 v. TCL Comm'n Tech. Holdings Ltd., the question of whether a defendant's standard-compliant product infringes a Standard Essential Patent ("SEP") merely because it is standard-compliant may be submitted to a jury. It is not necessary in every case involving SEPs to ask the jury to compare the patent claims to the accused infringing product. Moreover, there is no requirement of any prior ruling by the district court that compliance with mandatory sections of the standard necessarily results in infringement. READ MORE

China's Supreme People's Court Clarifies Application of Patent Law to Court Challenges of Administrative Reexamination and Invalidation Proceedings

Freedom-To-Operate Case Study
 
Osha Liang was commissioned to conduct an early-stage freedom-to-operate analysis for a client in anticipation of a strategic development project.  Due to the scope and complexity of the search, partner Carlyn Burton engaged a legal technology platform through which the risk analysis was performed, which allowed for significant improvements in efficiency and collaboration with the client.  The project has been written up in a case study, available here
