Pennsylvania Passes the Senior Protection Act
The Pennsylvania General Assembly unanimously approved House Bill 2510, the  Senior Protection Act to Safeguard At-Risk Seniors , on May 28, 2020, and Governor Tom Wolf signed the bill into law on Friday, May 29, 2020.

This legislation will provide $245 million for a one-time payment to nonpublic and county nursing homes. $196 million will be distributed based on each facility's percentage of Medical Assistance (MA) bed days for the third quarter of calendar year 2019 and $49 million will be based on a facility's percentage of licensed beds as of March 31, 2020. If you would like assistance in understanding or estimating your facility’s distribution from this bill, please contact us.

The bill will also provide $140 million to be distributed to home health care and home care providers of personal assistance services. $50 million will be used for assisted living residences and personal care homes. Additionally, there will be $13 million allocated for adult day care services, $1 million for residential habilitation services, $8 million for ventilator or tracheostomy qualified nursing facilities, and $10 million for Living Independence for the Elderly (LIFE) programs.

The legislation notes that facilities receiving a payment must have been in operation as of March 31, 2020. Payment recipients shall provide documentation to the Department of Human Services (DHS), upon request, for purposes of an audit review. Payments received may only be used to cover COVID-19 related costs not otherwise reimbursed by federal, state, or other sources of funding, and incurred during the period between March 1, 2020, and November 30, 2020.
