Net Neutrality Ruling Gives States and Local Governments Some Flexibility

The D.C. Circuit upheld most of the Federal Communications Commission’s
2018 order
retreating from net neutrality. But the court struck down the portion of the order disallowing states and local governments from adopting measures preempting the order. Numerous states and local governments challenged the legality of the order.
Net neutrality requires internet service providers to treat all Internet communications the same and not block, speed up or slow down any content. Net neutrality was federal policy until the 2018 order.
The technical legal question in
Mozilla Corporation v. FCC
was whether broadband Internet is a “telecommunications services” under Title II of the Telecommunications Act of 1934 or an “information services” under Title I. In the 2018 order the FCC classified broadband Internet as an “information service.” Title II entails common carrier status while Title I does not. Notably, Title II “declar[es] . . . unlawful” “any . . . charge, practice, classification or regulation that is unjust or unreasonable.”
The D.C. Circuit likewise upheld the 2018 order’s classification of mobile broadband as a “private mobile service” not a “commercial mobile service” which is subject to common carrier status.
The states and local governments challenging the order didn’t entirely lose the case. The D.C. Circuit described the 2018 order’s Preemption Directive as “invalidat[ing] all state and local laws that the Commission deems to ‘interfere with federal regulatory objectives’ or that involve ‘any aspect of broadband service . . . address[ed]’ in the Order.” The court concluded the Directive exceeded the FCC’s statutory authority.
According to the
National Conference of State Legislatures
seven states—California, Colorado, Maine, New Jersey, Oregon, Vermont and Washington—have enacted legislation or adopted resolutions regarding net neutrality.
The D.C. Circuit also instructed the FCC to “adequately consider” the 2018 order’s impact on public safety, pole-attachment regulation, and the Lifeline Program.

California Attorney General Becerra Files Amended Complaint in Lawsuit Against Purdue Pharma, Adds Eight Additional Members of the Sackler Family

California Attorney General Xavier Becerra filed an amended complaint in his lawsuit against Purdue Pharma, adding eight additional members of the Sackler family. The complaint now includes Beverly Sackler, Jonathan Sackler, David Sackler, Marianna Sackler, Theresa Sackler, Ilene Sackler Lefcourt, Dr. Kathe Sackler, and Mortimer D.A. Sackler.
In addition to the amended complaint, Attorney General Becerra also joined a coalition of 23 attorneys general and formally opposed Purdue Pharma’s request to make $38 million in bonus, incentive, and other payments to employees. The Attorneys General filed a joinder to the United States Trustee’s objection to Purdue’s authorization request for their multi-million dollar incentive, bonus, and severance plans. Purdue made this request just two weeks after declaring bankruptcy in the face of multi-billion dollar liabilities for their role in engineering the opioid epidemic.

North Carolina Attorney General Josh Stein: Case Against Sackler Family Must Continue

Attorney General Josh Stein submitted additional filings related to his cases against Purdue Pharma and eight members of the Sackler family. Specifically, Purdue has sued Attorney General Stein seeking to stop his cases against it and the Sacklers due to the Purdue bankruptcy. Attorney General Stein’s filings oppose that effort.
Attorney General Stein took this action along with the Attorneys General of California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Idaho, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Hampshire, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, Washington, and Wisconsin

Youth Vaping Summit, Arkansas Attorney General Rutledge Highlights Dangers and Ease Of Access to Nicotine Products
October 7, 2019
Arkansas Attorney General Leslie Rutledge hosted the first Youth Vaping Summit in the State, welcoming over 200 to Children’s Hall at Arkansas Children’s Hospital Monday. By partnering with Arkansas Children’s and University of Arkansas for Medical Sciences (UAMS), participants received first-hand information on the health risks and long term dangers e-cigarettes and nicotine can have on children and teens.

North Carolina Attorney General Stein: Sexual Assault Kit Tracking Update: 1 Year In
October 3, 2019
This week marks the one-year anniversary of North Carolina’s sexual assault kit tracking system. On Oct. 1, 2018, Attorney General Josh Stein and the North Carolina State Crime Laboratory implemented a tracking system to ensure that survivors, law enforcement officers, and others would have a way to track sexual assault kits once they are collected to prevent backlogs and increase accountability.

Oklahoma Attorney General Hunter Announces State Awarded Grant to Address Rape Kit Backlog
October 7, 2019
Attorney General Mike Hunter announced the state has been awarded the federal Sexual Assault Kit Initiative (SAKI) Grant to help collect, prioritize and test a number of the sexual assault forensic evidence kits that have been identified in police evidence rooms.

California Attorney General Becerra and Assemblymember Rivas Bill to Prohibit Colleges from Withholding Transcripts as Debt Collection Tactic Signed into Law
October 4, 2019
California Attorney General Xavier Becerra and Assemblymember Luz Rivas (D-Arleta) announced AB 1313, their bill to help mitigate the student debt crisis, was signed into law. The bill prohibits postsecondary schools from withholding transcripts from students who owe a debt and ensures students are not hamstrung in pursuing educational and career opportunities by the practices of certain schools and colleges.
