CMS Approves Appendix K 
Last night, The Centers for Medicaid and Medicare Services (CMS) approved New York state's waiver application for 1915c Home and Community Based Waiver services, also known as Appendix K. The appendix provides relief in several areas that have been communicated by The Office for People With Developmental Disabilities (OPWDD) in various guidance documents.  This includes an allowance to bill for suspended day services through the retainer day methodology. 

A copy of New York's waiver application can be found here, and the signed CMS approval can be found hereThe first ten pages of the application identify the modifications to the waiver in broad terms. The remaining sections provide greater detail, with the specific modifications highlighted. OPWDD will be reviewing Appendix K with the Provider Association during today's 4 p.m. call, and plans to hold additional informational sessions on this in the future.

MC-COP Retainer Day Webinar - Thursday at 2 p.m.
The Office for People With Developmental Disabilities (OPWDD) is offering a webinar series in collaboration with the Managed Care Community of Practice (MC-COP), to assist providers in understanding guidance issued by OPWDD in response to the COVID-19 pandemic. Their next webinar, "Introduction to Day Services Retainer Program for Day Habilitation, Prevocational Services and Community Habilitation Providers," will be held tomorrow, Thursday, April 9 at 2 p.m., and will cover the following topics:
  • Overview of the program
  • What services qualify
  • Expectations of providers
  • How payments are calculated
  • How payments will be made
  • Which individuals can receive day services in their residences

Summary of CARES Act Benefits 
The Arc New York legal team developed a high-level summary of the Coronavirus Aid, Relief, and. Economic Security (CARES) Act and the applicability of its benefits for Chapters. This information was reviewed on our call with Executive Directors this morning. We will continue to update Chapters on federal relief as more information becomes available.
