Assessment, Training, and Reporting Tools for Virginia COVID Compliance
We want to share some resources that the Virginia Department of Labor and Industry (DOLI) has put out in the past month since its Emergency COVID Standard went into effect. We hope that having these resources is helpful for your planning. You should consult with an attorney for advice specific to your organization.
Developing an Infectious Disease Preparedness and Response Plan
Businesses with 11 or more employees with medium-risk jobs, or with any number of high or very high-risk jobs, must create an Infectious Disease Preparedness and Response Plan. DOLI has provided an Infectious Disease Plan Template that you can populate with your specific details. If applicable, this plan is required to be in place by September 25. DOLI has created this Hazard Assessment document which you can use to assess employees’ risk levels to determine if this requirement applies, and how to target training and other measures.
Reporting Positive Cases
The standard requires employers to notify DOLI if three or more employees present at the place of employment within a 14-day period testing positive for coronavirus during that 14-day period. Should this requirement apply, employers are required to file their notification within 24 hours of discovery. You can report through the federal OSHA reporting page, which is linked (along with these requirements) on the DOLI website.
Training Employees
Medium, high, and very high risk workplaces must provide COVID-19 training to employees, such as this presentation that DOLI created for Medium-Risk Training. This three-page Lower-Risk Training document provides information on COVID-19 hazards for lower-risk jobs. You can use this Training Certification Form to track and certify that employees have received their training.
