Coronavirus Update

Federal Response
Capitol Hill. The Senate passed the third coronavirus-related bill just before midnight on March 25, 2020. The nearly $2 trillion stimulus measure, the  Coronavirus Aid, Relief and Economic Security (CARES) Act , includes funding relief for both the private and public sector.

The House may vote on the legislation by voice vote on Friday, March 27. The House is likely to approve the bill by unanimous consent, thus avoiding the need to call back lawmakers to the Capitol for a vote. 

Following the House vote on the legislation, both chambers are expected to recess until April 20. Although, Senate Majority Leader Mitch McConnell (R-KY) has stated that the Senate will return if needed to address technical corrections to the CARES Act or to consider additional coronavirus-related legislation. 

Administration. The Federal Emergency Management Agency (FEMA) released guidance on the application process for submitting reimbursement requests through FEMA’s Public Assistance (PA) grant program for the COVID-19-related emergency and disaster declarations . As previously reported, local governments and certain private nonprofit organizations are eligible to apply for PA assistance for “Category B” activities. FEMA previously released a factsheet on which Category B activities would be eligible for reimbursement for COVID-19-related emergency and disaster declarations. 

On Tuesday, the Department of Labor (DOL) released a notice on the implementation of regulations under the Families First Coronavirus Response Act . The emergency leave requirements would not go into effect until April 1, 2020, and provide that an employer cannot deny leave prior to April 1 for reasons identified under the Emergency Leave Act. TFG is tracking the potential impacts of this rule on local and regional government. 
Advocacy
A group of nine organizations representing state and local governments wrote a  letter to President Trump requesting that the Administration pause or extend public comment periods for active rulemakings and non-rulemaking notices across the federal government to allow state and local governments “to focus on addressing the nation’s immediate pandemic response needs and ensure their ability to devote proper consideration of agency regulations.”

Over the last few days, national organizations including the National League of Cities and the U.S. Conference of Mayors pushed for provisions to be included in the CARES Act that would provide stabilization funding, tax credits, and municipal bonds to local governments. TFG was in close coordination with these groups on behalf of local and regional government.
