Effective July 13, 2020, Governor Newsom made a series of drastic moves designed to reduce the dramatic spread of COVID-19 in California. Using his "dimmer switch" approach to addressing COVID-19 mitigation as needed throughout the state, the Governor announced three major rollbacks to the state's reopening plans. If your business reopened and you are now forced to cutback operations and furlough workers, be aware that you will have to furnish employees with yet another CA WARN Notice if you temporarily laid off 50 or more employees within a 30 day period.

First, the following must close all indoor operations immediately:

  • Dine-in restaurants
  • Wineries and tasting rooms
  • Movie theaters
  • Family entertainment centers (for example: bowling alleys, miniature golf, batting cages and arcades)
  • Zoos and museums
  • Cardrooms

Second, the following must close entirely (both indoor and outdoor):

  • Bars
  • Brewpubs,
  • Breweries, and
  • Pubs

Third, counties that have remained on the County Monitoring List for 3 consecutive days will be required to shut down the following industries or activities unless they can be modified to operate outside or by pick-up:

  • Fitness centers
  • Worship services
  • Protests
  • Offices for non-essential sectors
  • Personal care services, like nail salons, body waxing and tattoo parlors
  • Hair salons and barbershops
  • Malls

It is important to note that this Order requires all work offices that are not part of the essential sectors to shut down immediately. California has identified thirteen (13) critical sectors which can be found here (click here) . If your business does not fall into one of the thirteen (13) critical sectors, employees must be sent home (except for those providing limited essential services.)

  • Colusa
  • Contra Costa
  • Fresno
  • Glenn
  • Imperial
  • Kings
  • Los Angeles
  • Madera
  • Marin
  • Merced
  • Monterey
  • Napa
  • Orange
  • Placer
  • Riverside
  • Sacramento
  • San Benito
  • San Bernardino
  • San Diego
  • San Joaquin
  • Santa Barbara
  • Solano
  • Sonoma
  • Stanislaus
  • Sutter
  • Tulare
  • Yolo
  • Yuba
  • Ventura
