Landlords of Buildings in 421-g Program Face New Threat of Overcharge Claims

In late June, the state's highest court ruled that units which were initially subject to rent stabilization law by virtue of their building receiving tax breaks under the "421-g" program, remain stabilized so long as the building continues to receive such benefits. This ruling, coupled with the expansion of the look-back period for rent overcharge claims (from 4 years to 6 years), this has opened the door for thousands of tenants who lived in such units to file overcharge claims against their landlord. The 421-g program has been available to landlords of buildings in Lower Manhattan since 1995 and can remain in place for up to 14 years.
