Child Custody

When his sixteen (16) year old daughter ran away from her mother's house, she ran straight to him. At that point, our client decided that he would fight to gain legal custody of his teen daughter. After several settlement discussions with the mother, prior to the final hearing, we were able to reach an agreement with the father as the primary legal and physical custodian of his daughter. The father's pending child support case was dismissed and the parties agreed that neither party would pay child support to the other party.

Divorce and Separation

Fenwick Thompson & Associates recommends that you take a written, pictorial, or video inventory of your assets, prior to agreeing to join households with someone, whether it be through a marriage or domestic partnership.

If the relationship comes to a point of final separation, what was yours before the combining of assets should be treated separately from what was acquired during the marriage, domestic partnership, or otherwise. Hold on to those receipts!!

A mother is estopped, as a matter of law, from challenging paternity of a child if paternity was previously established in a divorce case, held the 4th Division of the Georgia Court of Appeals in  Brooks v. Lopez, A19A0324 .

Child Custody
CHANGE OF CUSTODY, & CHANGE OF CIRCUMSTANCES Where a trial court orders a change of custody based on its conclusion the change is for the best interest of the child, without finding there has been a change in material circumstances, the case must be remanded to the trial court to address the issue, held the 4th Division of the Georgia Court of Appeals in  Burnham v. Burnham, A19A0675 .
