Important Update About NYCharities.org
It appears that NYCharities.org   lost its charitable status  in August of 2018. Our members have reported that they have not been able to get in touch with NYCharities.org by phone.  We have checked in with our friends at the  Lawyers Alliance for New York , and they suggest that if you are owed money by NYCharities.org, you should:
  1. Call the New York State Attorney General's Charities Bureau to report your situation. You can call Karin Kunstler Goldman, Deputy Bureau Chief - Charities Bureau, at (212) 416-8392
  2. Call your insurance provider to report the issue
  3. File a police report (we've been hearing that the police won't take a report, and instead direct you to the Charities Bureau, but you should call your local precinct to see if they will take a report)

It's (almost) official! On July 31, 2019, the members approved a resolution to change our certificate of incorporation to reflect our new name. We now begin the process of filing with the state for the official change. Thanks to all of you who sent in proxies and attended the Special Meeting!

ABNY, City Parks Foundation and Local Leaders Launch SummerStage Census Awareness Campaign
The Association for a Better New York (ABNY) announced that it has joined with City Parks Foundation and community partners to conduct outreach about the 2020 United States census at Capital One City Parks Foundation SummerStage concerts , New York's largest free outdoor performance arts festival. The effort is one of a variety of ways local leaders, community groups, and ABNY's Census 2020 for a Better New York committee are working to educate New Yorkers about the census and help ensure the most accurate census count possible in 2020. People interested in volunteering to raise awareness about the census in their communities will be able to sign up with the help of tablets that were donated by Google in partnership with Tech:NYC .
STATEWIDE NEWS
Nonprofits Stabilize and Build New York's Economy
The New York State Comptroller's Office released a report on the economic impact of the nonprofit sector, which accounts for 18% of private sector jobs in the state. The report found that nonprofits in New York provided more than 1.4 million jobs in 2017 and paid over $78 billion in wages, leading the nation by both measures. The report also notes that nonprofits helped stabilize the economy through the Great Recession and wages at nonprofits have grown faster than the private and public sectors from 2007 through 2017.
Governor Signs Pay Equity Bills
At a ticker tape parade for the U.S. women's soccer team, Governor Cuomo signed a pair of equal pay bills that expand pay laws to prohibit unequal pay on the basis of a protected class for all substantially similar work (S5248B/A8093A), and forbids employers from asking prospective employees about their salary history (S6549/A5308B). This means that nonprofits should assess their job descriptions to make sure that "substantially similar work, when viewed as a composite of skill, effort, and responsibility, and performed under substantially similar working conditions" is paid at the same rate. New York City nonprofits have been prohibited from asking about salary history since 2017; now all New York State nonprofits are prohibited. [Related: The prevailing wage bill that would have required union-level pay and benefits for construction workers on projects receiving any government subsidy failed to get across the finish line this year.]

New York State Civil Rights Laws Ban Discrimination Based on Hairstyles or Hair Texture Associated with Race
On July 12, Governor Cuomo
signed 
S6209A/A7797A, a bill adding hairstyles and traits historically associated with race to the state's anti-racial discrimination laws, amending the state's human rights law and the Dignity For All Students Act to add new sections on the definition of race, including traits historically associated with race, including but not limited to hair texture and protective hairstyles. The new law is effective immediately. The New York City Commission on Human Rights put out guidance on this issue in February 2019.
Governor Signs Bill Protecting Immigrants From Workplace Harassment
On June 27, Governor Cuomo signed S5791/A5501 which amends the labor law to add anti-discrimination statutes to include threats or punishment against an employee based on immigration status and bans employers from threatening to call immigration enforcement authorities in retaliation against employees as well as their family or household members.
Governor Signs Climate Change Legislation
On July 18, Governor Cuomo 
signed the Climate Leadership and Community Protection Act which codifies goals to reduce carbon emissions by 85 percent in the next 30 years and shifts the state to 70 percent renewable energy by 2030 and a 100 percent carbon neutral system by 2040. While it is clear that, for nonprofits that own buildings, performance-based standards, new benchmarks, and energy codes will likely require capital expenses for electrical, heating, and water renovations, Nonprofit New York will monitor the impact of this legislation on nonprofits as it is implemented. A State Climate Action Council has up to two years to prepare and approve a plan to achieve these statewide emissions targets, and the State has one year to consider establishing a mandatory registry and reporting system from sources of greenhouse gas emissions. The legislation requires at least two public hearings with input from regulated entities, including nonprofits, before final compliance rules are set on or before June 2023.

Divisions of Licensing and Corporations Experiencing Phone Issues
The Department of State's Divisions of Licensing and Corporations haven't been able to able to take calls since February, and is instead advising people to
send inquiries by email ([email protected] and [email protected]) which can take three to five days to get a response.

NATIONAL NEWS
Mandated E-Filing of Nonprofit Tax Returns
The Taxpayer First Act
, a bipartisan bill designed to modernize the Internal Revenue Service, became law on July 1, 2019. This law requires tax-exempt organizations to electronically file tax forms 990, 990-EZ, and 990-PF. Prior to the law, only the largest and smallest nonprofits are required to file their IRS annual reports electronically (although many nonprofits did this, without the requirement). The mandatory e-filing requirement would take effect for tax years after July 1, 2019. Nonprofits with revenues below $200,000 and assets of less than $500,000 will have an additional two years before the electronic filing requirement is implemented. Additionally, the Act requires the IRS to provide notice before automatically revoking nonprofits' tax-exempt status for failure to file 990s for three consecutive years.
Streamlining Grants Compliance
The Office of Management and Budget released its 2019 Compliance Supplement , which eliminates overly burdensome compliance requirements. The new framework is designed to allow nonprofits and other grant recipients, program managers, and auditors to focus on areas of highest risk. This year, for the first time, instead of agencies requiring auditors to review a maximum 12 compliance areas, the Supplement provides instructions to review up to six of the most critical compliance review areas based on program needs.
Student Loan Forgiveness Lawsuit

The American Federation of Teachers (AFT) is suing Secretary of Education Betsy DeVos for denying thousands of eligible candidates, including nonprofit employees, relief under the Public Service Loan Forgiveness (PSLF) program. Less than one percent of the more than 75,000 applicants under the PSLF program - 518 individuals - received loan forgiveness. AFT is calling for a restoration of the program to legal standards, as well as instituting an appeals process for those wrongfully denied loan forgiveness.

Individual Giving Down in 2018
Giving USA released its
report on 2018 giving. Their data are consistent with reports that came out earlier in the year, noting a decrease in individual giving. This continues to be an area to watch for 2019 giving, as there are indications that the change to the tax law has had an effect on giving, an effect that may become more pronounced now that people have filed their taxes for the first time under the tax law and have a better understanding of how the new system will work.

Federal Court Overturns Donor Disclosure Rules for 990s
On July 30th, a federal judge overturned an IRS ruling (Revenue Procedure 2018-38), which allowed many nonprofits (although not 501(c)(3) nonprofits) to omit donors of $5,000 or more from Schedule B of their 990s. It is unclear whether the IRS will appeal. For more information, see Venable LLP's Nonprofit Alert.

The New York Immigration Coalition's Know Your Rights Community Toolkit Addresses Immigration Questions or Impact by ICE raids
The New York Immigration Coalition (NYIC), a member of Nonprofit New York, has a webpage and dedicated resources in 12 languages i n anticipation of potential ICE raids in communities around New York State. NYIC wants to ensure that service providers and community members have access to information about their rights when interacting with ICE, and access to resources and support. Learn more.

Sax LLP Announces the 2019 Founder's Award Submission Window is Open

The Mortimer & Mimi Levitt Foundation has a grant opportunity for nonprofits serving small to mid-sized towns and cities across the country.
