States Dictating Standards - Will They Succeed?
State efforts to regulate the labeling of food products have exploded since last August, when Missouri became the first of 11 states (and counting) to enact legislation to regulate the  labeling of cell-cultured meat (CCM) and its plant-based alternatives. Since then, at least 26 states have pursued similar legislation and expanded their scope. Illinois is requiring  mandatory labeling of sesame allergens on all food products; 
Louisiana has additional protections for crawfish, shrimp and sugar;  and  Arkansas outlaws milk  that doesn't come from an animal, and even includes grain-alternatives such as cauliflower rice.
 
In response, makers of plant-based foods,  the ACLU  and other organizations, are suing the various states, claiming free speech protections and competitive disadvantages. In addition,  very few states have acknowledged the challenge of federal preemption which says that state laws cannot conflict with federal law. 

The formal FDA-USDA agreement to share jurisdiction over 
cell-cultured meat , coupled with this wave of state-led initiatives and increasingly popular and accessible alternative foods, has cast the shadow of federal preemption over states with strong agriculture industries. These developments raise two main questions:
  1. How will federal preemption claims specifically affect provisions on cell-cultured meat compared to provisions on plant-based alternative products
  2. Could these state laws currently survive a legal challenge based on federal preemption or other grounds?
