The Hub - In response to the many challenges the accommodation industry has been facing over the last 18 months, the Accommodation Association will soon be launching ‘The Hub’, a community based platform that’s home to the latest job postings for the industry as well as a host of free training courses, videos and helpful articles.

Developed in collaboration with Olive Group, The Hub is free to join and provides a central platform for a range of industry specific online training courses, a jobs board where you can view and apply for the latest jobs and a suite of helpful videos, articles and resources to further enhance your industry skills.

Government Advocacy
In our last Key News Update, we wrote about how the mindsets of all governments had begun to shift from case numbers to vaccination rates. Now that the vaccination targets agreed to by National Cabinet are being met and exceeded, the mindset of governments has yet again shifted from lockdowns to lockouts of the unvaccinated and to change the policy settings embarked on to protect the economy to assisting the economy recover. With those changes of political and policy priorities comes opportunity and the Association is shifting its advocacy focus to advocating for governments to assist in driving demand growth and ensuring the policy settings are right to help the sector retain and recruit employees.

Hospitality Industry Award Update

This a recap of some of the recent changes to the Hospitality Industry (General) Award (HIGA).

Wage increase
Effective from the first full pay-period commencing on or after 1 November 2021, the base rate of pay for all wage classifications was increased by 2.5%. For members’ convenience, the new rates, penalties and allowances have been summarised, and may be downloaded here: Hospitality Industry (General) Award 

Loaded Penalty Rates
On 3 September, the Award was updated giving employers an option to pay some employees a loaded rate of pay instead of certain award entitlements. This option is only available to full-time adult employees classified at Level 3 or above.
The loaded rates replace:
·      Overtime payments (cl 28) – (except for clauses 28.2(d) to (f) dealing with RDOs and ADOs)
·      Penalty rates (cl 29) – (with the exception of penalty rates in relation to public holidays)
·      Split shift allowance (cl 26.14(b)(i)).
 
Schedule K of the Award lists the loaded rates and conditions that apply.

Can organisations defame people without saying anything?

A.     In short, yes. My colleague Andrew Nicolson recently explored the high court judgement in Fairfax Media Publications v Voller, which has opened the way for those who are targeted by keyboard warriors to bring a complaint against the owner of the social media page, rather than the troll itself. This case confirmed that publishers (including anyone who owns a social media page) can be liable for defamatory comments even where they are unaware of the nature of the comments and are 'publishers without notice'.
