Ohio Ranked 15th Worst Legal Climate in Nation
Ohio’s legal climate received its lowest grade in fifteen years from the U.S. Chamber of Commerce’s Institute for Legal Reform 2019 Lawsuit Climate Survey. Unfortunately for Ohio businesses, we dropped nine spots from 2017 to a ranking of 35th best – or 15th worst – legal climate in the nation.
The survey results are based on interviews with over one thousand corporate attorneys who represent or work for public and private companies with at least $100 million in annual revenue. The survey asks these attorneys to rank a state based upon ten characteristics of the judicial system. These characteristics include enforcing meaningful venue requirements, treatment of tort and contract litigation, treatment of class actions and multi-district litigation, trial judges’ impartiality and competence, jury fairness and quality of appellate review.
Ohio has progress to make in each of these fields because the state failed to break into the top 30 states in any category. Trial judge impartiality was the state’s highest ranking at 32nd and quality of appellate review was the state’s lowest ranking at 39th.

Trade Anxiety Spreads
to Middle-Sized Companies
Earlier this month, we learned that Fortune 500 companies are increasingly concerned about trade tensions and tariffs. We also saw evidence that small manufacturers are losing confidence, with lower revenue expectations and reduced hiring plans. And now, it seems this concern is spreading to middle-sized companies.
According to this quarter’s RSM US Middle Market Business Index (MMBI) 40% of middle market leaders reported that tariffs on imported goods are posing challenges for their businesses and 26% cited a negative impact from retaliatory export tariffs. Overall, the MMBI dropped to 129.4 in Q3, down from the 132.3 last quarter.
Here’s more from the report…and it’s not pretty:
It is important to note that the third-quarter MMBI survey was conducted prior to the most recent escalation of the trade war between the United States and China, the resulting impact on the global supply chain and the ensuing tightening of financial conditions reflected in declining stock prices, an inversion of the yield curve and a widening of credit spreads in the bond market. These developments may cause further deterioration of middle market business sentiment in coming quarters.

Today in History
- September 20, 1881 -
From History.com:
Chester Arthur is inaugurated on September 20, 1881, becoming the third person to serve as president in that year.
The year 1881 began with Republican Rutherford B. Hayes in office. Hayes served out his first and only term and officially turned over the reins of government to James A. Garfield, who happened to be a close friend of his, in March 1881. Just four months into his term, on July 2, Garfield was shot by a crazed assassin named Charles Guiteau. Guiteau claimed to have killed Garfield because he refused to grant Guiteau a political appointment. Garfield sustained wounds to his back and abdomen and struggled to recover throughout the summer. Though it appeared he would pull through in early September, the autopsy report revealed that the internal bullet wound contributed to an aneurism that ultimately killed Garfield on September 19.
The next day, Vice President Chester Arthur was sworn in as president. Strangely, Garfield’s assassin wrote to the new president from jail, taking credit for vaulting Arthur into the White House. According to President Hayes, Arthur’s administration was best known for “liquor, snobbery and worse.” He served only one term from 1881 to 1885.
This was the second time in American history that three men served as president in one year; a similar situation occurred in 1841, when Martin Van Buren, William Henry Harrison and John Tyler all held the office.
