Governor Extends State of Emergency to May 28State of Emergency Extended to May 28Last night, Governor Gretchen Whitmer issued three executive orders which effectively extend Michigan’s states of emergency and disaster to Thursday, May 28, 2020. The Legislature earlier declined to extend the state of emergency but passed legislation, Senate Bill 858 (Senator Tom Barrett, R-Charlotte), that would codify and extend several of the executive orders issued to protect Michigan citizens during the COVID-19 pandemic, though the Governor is expected to veto the bill. Both chambers also passed resolutions permitting their respective leaders to mount a legal challenge to the Governor’s authority to authorize ongoing states of emergency without legislative approval (House Resolution 250 and Senate Resolution 114). Though this battle between the Governor and legislative leaders points toward growing public discontent with restrictions and poses questions about the legal foundations of the Governor’s orders, manufacturers are advised to continue to abide by the requirements of the orders until and unless they are clearly invalidated by a court. Some "Low Risk" Industries Permitted to Resume In-Person Work May 7Just today, Governor Whitmer signed Executive Order 2020-70 that keeps the “Stay Home. Stay Safe.” order in place through May 15 but allows for the resumption on May 7 of some types of in-person work considered low risk, including construction, real-estate and work that is primarily performed outdoors. These businesses must adopt specified measures to protect their workers against the spread of COVID-19. MMA is working with both the Whitmer Administration and legislative leaders to urge swift action to permit Michigan’s manufacturing industry to resume operations.
